"Since you work in food production, the company has a right to know if you've had the COVID vaccine."
At my job, out of the blue and with no prior notification, a nurse who works for the company called every employee into the office one by one, to ask if they've had the COVID vax. The reason (which I don't know if I believe) is when a certain number of employees have the vax, the company can drop the mask mandate.

A very few people returned, irritated, muttering under their breath, "They can't be asking about this. Its against the law."

When my turn came, I simply stated to the nurse that my health history is confidential between me and my doctor. And this is protected by federal HIPA law.

The nurse said, "I understand that. I'm not trying to violate HIPA law. But since you work in food production, the company has a right to know if you've had the COVID vaccine. You can ask HR if you don't believe me, they'll tell you the same thing. The vax isn't being mandated. They just simply want to know."

I replied, "I have nothing to say, apart from what I've already said."

The nurse seemed a bit puzzled and said, "OK" and I left.

I thought that would be the end of it and quickly forgot about it. But then a high-level company manager, who has the power to fire me on the spot for no reason, came to me and said sternly, "You need to answer the nurse's question right now. Its just a YES or NO question."

So, now feeling intimidated, feeling my job is now on the line, I relented. I went back to the nurse, and answered the question.

I never really thought sh*t would come to this. They claim the vax isn't being mandated. But in my opinion, this is the first step in the path to mandating it. I feel in my gut that somewhere down the line, they have every intention of mandating it.

What could I have done differently, that wouldn't have put my job at risk? What would you have done if you'd unexpectedly been pushed into this situation?

I suggest don't lie.

If enough people don't lie, I suspect our numbers are much stronger than they want to admit.

when you lie or get fake vax cards you are making it so much harder for those who have decided to put a line in the sand.

Seems to me if they now have a tally and take some kind of action against you for nearly anything in the future - it could be considered discrimination which is why they really shouldn’t violate HIPPA as they have

A tally was definitely being taken. A printout of all employee names was on the nurse's desk, with some names highlighted yellow.

But I don't think a discrimination claim based on vaccination status is a thing. Or if it is, I've never heard of it.

A possibility that I'm mulling over in my head is: at least now with the tally, if they ever want to mandate the COVID vaccine, they don't have to explicitly say so. They now know who they need to get rid of, based on vaccination status. And who to hire, based on vaccination status. It will probably become a standard question on the job application, if it isn't already.

Never tell off your boss.

I’m not a lawyer but ifir a similar issue a while back i “successfully” used the following general strategy.

Next time politely ask that your boss send you a formal written notice of the requirement concerning such.
Then formally write HR or some internal legal department inquiring if this is their policy and if participation is mandatory, kindly suggest that they may be taking a legal risk in pursuing such information from “others” in the Office that don’t care for the company as much as you do.
If they continue to push the issue give them your doctors/hospital contact information; make sure you contact your doctor notifying him/her NOT to divulge your information.

If they still continue to make an issue place on your desk a sealed large envelope with the answer and with the outside of the envelope clearly marked as private protected medical information concerning your vaccination status and current medical health. Inside have your FULL vaccination and other private medical records.

Do Not open the letter for them, make it clear to your coworkers that you don’t give anyone permission, write HR and/or legal department that only those with written permission and/or explicitly allowed by law may open your medical records.

Be prepared to sue.
If they open it, they will have likely violated the law even in excess of whatever covid “rules” are being paraded as law as those rules won’t apply to the other medical records.

If they fire you for not divulging the information, you will have records and witnesses that you legally made readily available your medical records and were willing to provide said records to anyone the law required you to provide them to.

If they fire you for presumably other grounds, you will have some recourse to show that the actual reason was pertaining to non-work performance issues.

In the meantime, be the absolute best employee you can be and document everything so you will have proof thereof. Follow up on conversations from your boss or higher ups about the vaccine politely but succinctly stating in writing what you understood their position to be and asking for further clarification. Be prepared for them to try to answer in person and to avoid written records; if so, keep politely asking about their position and asking for a written explanation or confirmation as the vocalized conversations are inconsistent and/or incomplete and/or contradictory to what others have told you.

I should clarify that for me, “successful” still meant being fired, but did ultimately result in substantial monetary compensation.

Taco bell in my area closes at 4:00pm because they can't find enough workers. A bunch of pizza places stopped doing deliveries because there's not a driver.
