I am writing you to make you aware that I hold a specific religious belief that prevents me from taking a Covid Vaccine. Per United States Federal Labor and Employment Law, my religious beliefs cannot be used as grounds for any termination / retaliation / discrimination. Additionally, I am under no obligation to be specific with you of these beliefs, to enumerate them, or be asked or required to defend them.

Please be advised that vaccinations (and certain other medical procedures/applications) violate my deeply held religious convictions. Accordingly, I am exercising my federally protected rights under 42 USC § 2000e–2(a)(et seq) which read as follows:

Unlawful employment practices

(a) Employer practices

It shall be an unlawful employment practice for an employer—

(1) to fail or refuse to hire or to discharge any individual, or otherwise to discriminate against any individual with respect to his compensation, terms, conditions, or privileges of employment, because of such individual’s race, color, religion, sex, or national origin; or

(2) to limit, segregate, or classify his employees or applicants for employment in any way which would deprive or tend to deprive any individual of employment opportunities or otherwise adversely affect his status as an employee, because of such individual’s race, color, religion, sex, or national origin.


Therefore, please place this letter in my appropriate HR file as a substitute for any such "proof of vaccine" or "certificate of vaccine" that you may need.

To begin, a simple fact - when seeking / discussing / considering any legal advice... CYA... as in C Your Attorney!

With that said, I have researched the topic of employer mandated vaccines thoroughly, and have arrived at what I believe is not only THE BEST OUT, but THE ONLY OUT

While US Law allows the various states a lot of autonomy with their specific state level employment laws, there are special federal statutes that encompass ALL employers in the US, regardless of state of incorporation, principle place of business etc.

The ones we NEED BE MOST aware of relate to statutes overseen by the EEOC.

In the most basic summary these laws specfically prohibit ANY and ALL discrimination based on several protected classes including RELIGION.

These laws trump "right to work state laws" or "at will employment" laws.

The reason employers can and will be firing people who do not comply is because those employees refusing are doing it IN THE WRONG WAY!

Now, can an employer still fire you after sending this letter? Sure? Will they look for reasons to fire you after you send this that may be unrelated to your vaccine status (such as nitpicking work, or makin up conduct violations)? Sure.

BUT

They will KNOW that this letter exists and ANY employment lawyer is going to love you. These are the kinds of cases that have a chance and employers know it. Peace and blessings.

The pilot's attorney can argue that the employer retaliated against the employee because of his religious belief. The risk of a lawsuit and the ensuing costs is likely to scare them enough to leave you alone. If they go after you, it just gives your attorney ammunition to legally fight them and that only hurts their pocket book. They would try to avoid the legal costs and just either sweep it under the rug and leave you alone or if they actually got sued, to settle quietly and avoid further litigation.

As was mentioned in trufserum's thread, it is doubtful that a Doctor would risk losing his medical license by signing an exemption for an allergy without first testing you and verifying that it is true. You can claim to be allergic but what Doctor would just take your word for it and just sign an exemption without testing you?

8) EUA products are unapproved, unlicensed, and experimental. Under the Nuremberg Code—the foundation of ethical medicine—no one may be coerced to participate in a medical experiment. The individual’s consent is absolutely essential. No court has ever upheld a mandate for an EUA vaccine. In Doe #1 v. Rumsfeld, 297 F. Supp. 2d 119 (2003)15, a federal court held that the U.S. military could not mandate EUA vaccines for soldiers: "…[T]he United States cannot demand that members of the armed forces also serve as guinea pigs for experimental drugs" (Id. at 135). Are you aware of this?

9) The United States Code of Federal Regulations16 and the FDA require the informed consent of human subjects for medical research. The EUA Covid-19 injections are unapproved, unlicensed, investigational vaccines that are still in their experimental stage. It is unlawful to conduct medical research on a human being, even in the event of an emergency, unless steps are taken to secure the informed consent of all participants. Are you aware of this?

10) According to Federal Trade Commission (FTC) Guidelines17 and the FTC’s "Truth In Advertising,"18 promotional material—and especially material involving health-related products—cannot mislead consumers, omit important information, or express claims. All of this falls under the rubric of "deceptive advertising" (whereby a company is providing or endorsing a product), whether presented in the form of an ad, on a website, through email, on a poster, or in the mail. For example, statements such as "all employees are required to get the Covid-19 vaccine to make the workspace safe" or "it’s safe and effective" leave out critical information. Critical information includes the facts that Covid-19 injections are unapproved EUA vaccines that "may" or "may not" prevent Covid, won’t necessarily make the workspace safer, and could in fact cause harm. Not providing links or attachments of the manufacturers’ fact sheets and current information on adverse events is omitting safety information. Are you aware of this?

11) Since the Covid lockdowns began over one year ago, there have been over 178 reported breaches of unsecured protected health information (PHI), incidents investigated by the Office for Civil Rights (OCR). These breaches exposed millions of people’s personal health information. Although many of these incidents were attributed to hacking, some of the breaches to PHI fell directly under the 1996 Health Insurance Portability and Accountability Act (HIPAA), such as sharing a patient’s or person’s information with an unauthorized individual or incorrectly handling PHI.19 Can you please explain your obligations to me, under HIPAA law, and how you are going to protect my personal information – both with respect to your requirement that I receive this injection?

12) Whereas pharmaceutical companies that manufacture EUA vaccines have been protected from liability related to injuries or deaths caused by experimental agents since the PREP Act1 was enacted in 2005, companies and all other institutions or individuals who mandate experimental vaccines on any human being are not protected from liability. Are you aware that you do not enjoy such liability protection?

Per United States Federal Labor and Employment Law, my religious beliefs cannot be used as grounds for any termination / retaliation / discrimination. Additionally, I am under no obligation to be specific with you of these beliefs, to enumerate them, or be asked or required to defend them.

Please be advised that vaccinations (and certain other medical procedures/applications) violate my deeply held religious convictions. Accordingly, I am exercising my federally protected rights under 42 USC § 2000e–2(a)(et seq) which read as follows:

Unlawful employment practices

It shall be an unlawful employment practice for an employer—

Except that I would lost my belief. I legitimately cannot take the vax for religious reasons due to its connection with COVID. Saying that I am under no obligation to list the belief won’t be enough if they fire you and you have to go to court.
