More: Will northern Michigan students be wearing masks this fall? We reached out to Michigan's Unemployment Insurance agency and asked if someone is fired for refusing a vaccine are, they still eligible for unemployment. They provided their answer in the following statement. “Unemployment benefit determinations are made on a case-by-case basis. UIA looks at each individual application and conducts an analysis of the facts – including whether the employee's refusal to get a COVID vaccine falls under Section 29(1)(b) of the Michigan Employment Security Act (which covers the termination of a worker due to misconduct) – before making a final decision regarding eligibility. Generally, as provided by the U.S. Equal Employment Opportunity Commission, employers may have the right to require employees to be vaccinated against COVID-19 with limited exceptions.” While that may not be a definitive yes or no to the question, Nacht, a lawyer who fights every day on employee's behalf says it would be an uphill battle to get benefits. "I expect, given the history of Michigan's unemployment system. I'm sure they'll reject the claim. So, then there'll be a fight" says Nacht. Although a proven winner in the courtroom, Nacht says based on the legal grounds and precedents, it’s not something that even he would be hopeful in coming out of victoriously.
