I am being bullied by my HOA. It's an abusive government almost like a microcosm of the federal. Did they overplay their hand?

HOAs are cash cows for big time law firms.
They keep them on retainer.

Big time law firms have state reps on their staff so the state legislature will never write a law protecting the home owners.

Judges always rule in favor of HOA.

Just get out with as little loss as you can.

The complex is small less than 20 units.

Doesn’t matter, the law will be on their side, it will be a war of attrition and you will pay to fund the people you’re fighting.
The only way to stop their law firm is to bankrupt yourself.

Just realize you made a mistake by living in an HOA and extract yourself from the situation with as little loss as possible.

Without knowing your complete circumstances it’s hard to say either way.

I made a mistake buying a nice home in an uppity gated community here in N. Orlando. It became intolerable when I started getting letters from neighbors complaining about my diesels exhaust and my kids laughing and playing in their own yard.

I sold my house and moved into a much smaller yet much better home on 5 acres. It still has the 5 bedrooms I need for my 4 kids and is on almost 6 acres and best of all......no fucking nosey neighbors. I can literally do whatever I want.


I love rural areas. My kids are thriving and my stress level is much lower. What neighbors I do have enjoy shooting guns on their property and see the world much like I do. When SHTF happens, my little community will be ok.

HOAs could be a good thing. Unfortunately, they almost never are.

The biggest problem with them, and the reason you will most likely lose is that you willingly entered into an agreement with them, and you are now bound by that agreement.

They write those agreements in such a way that they can do pretty much whatever the hell they want, and as long as you've been given proper notice (could be 24hrs, could be 30 days, seems arbitrary), you have to comply or you will be fined (or worse).

You can be certain all of their documents are in order to "prove" that you are in the wrong.

I will not abide an HOA. They tried to bring one in after I bought my house and I (along with a few other neighbors) ran them off. It's just legal tyrrany. NEVER agree to that.

Make no oath. If you do, you are accountable.

Sue the shit out of them! Even if you lose, a long drawn out battle will be costly to them. Once the rest of the residents see their monthly dues jump (to cover legal fees), they'll freak out on the board of directors.

You bought into an HOA which has governing corporate documents

Try reading the documents and following the rules

If you don’t like it, run for hoa and change the rules

If that’s too much of a burden, move.
