Judge Terry A. Doughty in the U.S. District Court Western District of Louisiana ruled in favor of a request from Republican Louisiana Attorney General Jeff Landry to block an emergency regulation issued Nov. 4 by the Centers for Medicare and Medicaid Services that required vaccines for nearly every full-time employee, part-time employee, volunteer, and contractor working at a wide range of healthcare facilities receiving Medicaid or Medicaid funding.

Louisiana was joined in the lawsuit by attorneys general in 13 other states.

Doughty argued in his ruling that the Biden administration does not have the constitutional authority to go around Congress by issuing such a mandate.

"If the executive branch is allowed to usurp the power of the legislative branch to make laws, two of the three powers conferred by our Constitution would be in the same hands," he wrote. "If human nature and history teach anything, it is that civil liberties face grave risks when governments proclaim indefinite states of emergency.

"During a pandemic such as this one, it is even more important to safeguard the separation of powers set forth in our Constitution to avoid erosion of our liberties," he added.

Noting that the case "will ultimately be decided by a higher court than this one," Doughty wrote, "However, it is important to preserve the status quo in this case. The liberty interests of the unvaccinated requires nothing less."

My entire argument against the mRNA inoculation is why do you need to encode the cell to code a fragment of a virus spike protein but just skip that step and encode the cell to produce an antigen to the spike protein fragment to begin with???

It has been this way for at least 15 years, at least as long as I've been "antivax". Society doesn't like people who do not conform. In some ways it is helpful, in other ways it's totally destructive. If we can reach a point where individual liberty is respected, that would be best.

It's so strange to watch people arguing for or against covid jabs using rhetoric I've heard over and over again for 15 years as if these are brand new arguments. But at the end of the day, the "antivax" logic is still correct and true. Vaccines do not prevent or eradicate disease, if the vax works for you, no need for me to take it if I am either not concerned about getting sick or am confident in my immune system, and vaccines are pure toxic garbage with very severe potential side effects including permanent disability and death.

I will take my chances without the jab (any of them) or any other prescription meds for that matter. Nutrition and homeopathy are all my immune system needs and I've made peace with my Maker.

I have a supreme wait and see approach. These shots are not fully approved so one cannot be compensated for any adverse effects. Looking at the data locally (Chicago) it was only in the last week of October when the vaxxed started dying in larger numbers than the unvaxxed. I am gaining the opinion that 2022 = 1919 the second season was worse than the first and vaccine status is not a factor.
