My first thought is this: Does he own the property, or not? If so, then the court can silence itself. Ownership should mean that one can do anything legal on it, without being bothered by the state.

His son has been taking care of the property, but had been out of the country for 3 months and that's when it deteriorated? I'm not buying that. That is more than 3 months of neglect. That is years of neglect. I can only imagine what the inside of the home looks like. I think they had been slobs long before the father got sick (if he is even sick). That being said, if neighbors knew their neighbor was ill, why didn't they pitch in to help keep the place looking decent? I agree nobody wants to live next to that kind of thing, but neighbors can help out.

The son is just using excuses. If his father was SO sick he couldn't do any yard work, then he was too sick to stay home alone for 3 months. Why didn't he hire someone to look after the father and the property? That's a bad son there.

Overall I can get why the judge fined him you can hire someone to clear the property and considering it’s a only $100 fine I don’t think it’s worth anyone’s time to start requesting medical proof of disability.
