If a president leaves office with any documents, the act of taking documents renders them declassified
levin lays it out in this fox piece.

"the former president has the legal right to access any and all documents during his presidency, classified or not.

they can declassify anything that they want to, and the very actions alone of taking documents, he can be said to have declasified them."

yet, here we are, still hearing lefty rags around the world crying that trump broke the law and must be punsihed.

clown world continues.

Re: If a president leaves office with any documents, the act of taking documents renders them declassified
interestingly (not really) if you search for info about presidential declassification, you will get a ton of newly published articles all claiming that thsi power is limited and doesn't include what trump did...

however, if you adjust the search date for things older than one year, you find a totally different take on this.

for example, this article from NBC news:

Can Trump Disclose Classified Information Whenever He Wants?

Trump, as commander-in-chief, not only has the power to classify information about national security matters, but he can choose to make them public.

Trump has legal authority to declassify intelligence

Despite the blowback, Trump is right.

But there is a process to declassify materials that Trump never went through. It's not an arbitrary or magical process.

So I hate to tell you but you are wrong OP and a clip of Fox News doesn't change that.

You yourself said most of the search results say he can't declassify documents by waving his hand but you told me to prove it you. Click the links yourself then and post both sides you homo.

Re: If a president leaves office with any documents, the act of taking documents renders them declassified
So, could Trump declassify National Defense Information at will? Essentially, the logic is that whoever has the authority to classify documents also has the authority to declassify documents. And, all classification authority under these executive orders ultimately stems from the president, so the assertion that Trump could have declassified those documents as he saw fit is probably plausible. However, valid declassification actions require procedures, records, and logging, and arguably ought to have been marked as declassified prior to entering into private hands. This defense has never been litigated, however, so the limits a president might have in this area remain uncertain. Typically, classification violations are handled administratively—revoked security clearance, terminated employment, etc.—and not as criminal cases

Re: If a president leaves office with any documents, the act of taking documents renders them declassified
There have been instances of presidents declassifying National Defense Information by fiat. For example, Executive Order 12937 (1994), issued by Bill Clinton, declassified a list of documents in the National Archives by fiat, allowing information in them to be retained only if it was otherwise required to be for reasons other than national defense (for example, if they violate the privacy of a federal employee).
 Quoting:

Stupid bill Clinton and his executive orders if he had trumps lawyers he would have known he can declassified documents just by waving his hand and thinking "Sim Sim Salabim!" (He doesn't even have to say it out loud)
