The U.S. judge named to review documents seized by the FBI last month at Donald Trump's Florida home pressed Trump's lawyers on Tuesday to say whether they plan to assert that the records had been declassified by the former president, as he has claimed.

Judge Raymond Dearie - serving as an independent arbiter, or special master, to vet the more than 11,000 seized documents and potentially recommend keeping some away from federal investigators - asked Trump's lawyers why he should not consider records marked classified as genuinely classified.

"If the government gives me prima facie evidence (a legal term meaning a fact presumed to be true unless disproved) that this is classified, and you decide not to advance a claim of declassification ... as far as I'm concerned that's the end of it," Dearie told Trump's lawyers in his first public hearing on the matter.

Roughly 100 of the documents seized in the court-approved Aug. 8 search at Trump's home in the Mar-a-Lago resort in Palm Beach had classified markings. Trump's attorney James Trusty told Dearie it is too early to say Trump had used his powers while still president to declassify the documents - a stance that Dearie suggested weakened the claim.

"You can't have your cake and eat it," the judge said.

Trump has said in social media posts that he declassified the records, but his lawyers have skirted the issue in court.

Attorneys for Donald Trump have repeatedly failed to show that the former president declassified government records that were taken from his Florida home as part of a criminal investigation, the Department of Justice told a federal appeals court.

The Justice Department made that argument late Tuesday as it sought to resume its review of records marked classified that were seized from Trump’s Palm Beach resort home Mar-a-Lago in an FBI raid last month.

The DOJ’s filing in the U.S. Court of Appeals for the 11th Circuit swung back at Trump’s lawyers, who earlier Tuesday asked the court to preserve a ruling from a lower federal judge that blocked the government from examining the seized documents.

Trump “again implies that he could have declassified the records before leaving office,” federal prosecutors wrote.

“As before, however, Plaintiff conspicuously fails to represent, much less show, that he actually took that step,” they wrote, referring to Trump.

The DOJ lawyers added that Trump “is now resisting” a request by a court-appointed special master for him to provide evidence that he declassified records that were seized.

“In any event, Plaintiff’s effort to raise questions about classification status is a red herring,” the prosecutors argued. “Even if Plaintiff could show that he declassified the records at issue, there would still be no justification for restricting the government’s use of evidence at the center of an ongoing criminal investigation.”

Lawyers for Trump and the DOJ appeared in Brooklyn, New York, on Tuesday afternoon for a conference with the special master, U.S. District Judge Raymond Dearie. He was picked for the role by Trump and appointed by Cannon, who herself had been nominated by Trump.

But in Tuesday’s court conference, Dearie expressed skepticism toward Trump’s lawyers about which, if any, of the seized Mar-a-Lago records had been declassified.

Why?

What is the legal way to declassify a document? The classification authority declares it unclassified. Who is the classification authority? The President has authority over all classified documents in the federal government.

If he says it’s unclassified, it is. It’s very simple.

Just because a document is marked does not mean it is classified. Most classified documents have a time limit, after that it’s unclassified, no one has to say anything or write a form or do anything.
