Trump has not once claimed declassification in any sworn affidavit, deposition or court filing.

You know why? Because perjury is a felony.

He needs to put up or STFU on his claim.

Re: Judge asks Trump's lawyers if he really declassified the docs found at Mar a Lago. Trump won’t say.
The U.S. judge named to review documents seized by the FBI last month at Donald Trump's Florida home pressed Trump's lawyers on Tuesday to say whether they plan to assert that the records had been declassified by the former president, as he has claimed.

Judge Raymond Dearie - serving as an independent arbiter, or special master, to vet the more than 11,000 seized documents and potentially recommend keeping some away from federal investigators - asked Trump's lawyers why he should not consider records marked classified as genuinely classified.

"If the government gives me prima facie evidence (a legal term meaning a fact presumed to be true unless disproved) that this is classified, and you decide not to advance a claim of declassification ... as far as I'm concerned that's the end of it," Dearie told Trump's lawyers in his first public hearing on the matter.

Roughly 100 of the documents seized in the court-approved Aug. 8 search at Trump's home in the Mar-a-Lago resort in Palm Beach had classified markings. Trump's attorney James Trusty told Dearie it is too early to say Trump had used his powers while still president to declassify the documents - a stance that Dearie suggested weakened the claim.

"You can't have your cake and eat it," the judge said.

Trump has said in social media posts that he declassified the records, but his lawyers have skirted the issue in court.

Trump has failed to show he declassified docs seized from Mar-a-Lago, DOJ tells appeals court

Attorneys for Donald Trump have repeatedly failed to show that the former president declassified government records that were taken from his Florida home as part of a criminal investigation, the Department of Justice told a federal appeals court.

The Justice Department made that argument late Tuesday as it sought to resume its review of records marked classified that were seized from Trump’s Palm Beach resort home Mar-a-Lago in an FBI raid last month.

The DOJ’s filing in the U.S. Court of Appeals for the 11th Circuit swung back at Trump’s lawyers, who earlier Tuesday asked the court to preserve a ruling from a lower federal judge that blocked the government from examining the seized documents.

Trump “again implies that he could have declassified the records before leaving office,” federal prosecutors wrote.

“As before, however, Plaintiff conspicuously fails to represent, much less show, that he actually took that step,” they wrote, referring to Trump.

The DOJ lawyers added that Trump “is now resisting” a request by a court-appointed special master for him to provide evidence that he declassified records that were seized.

“In any event, Plaintiff’s effort to raise questions about classification status is a red herring,” the prosecutors argued. “Even if Plaintiff could show that he declassified the records at issue, there would still be no justification for restricting the government’s use of evidence at the center of an ongoing criminal investigation.”

Lawyers for Trump and the DOJ appeared in Brooklyn, New York, on Tuesday afternoon for a conference with the special master, U.S. District Judge Raymond Dearie. He was picked for the role by Trump and appointed by Cannon, who herself had been nominated by Trump.

But in Tuesday’s court conference, Dearie expressed skepticism toward Trump’s lawyers about which, if any, of the seized Mar-a-Lago records had been declassified.

Trump is a dumbass who didn't pack the boxes or check the contents. He has no idea what was in there.

He just wanted to say no and refuse to hand things over as his last pathetic power play against Biden.

He didn't drain the swamp.

He locked down the country and destroyed the middle class economy.

And worst of all, ran a pathetic 2020 campaign that was so bad he actually lost to Biden.

Because now the 100 documents that the DOJ claims are classified the DOJ has to prove each one is in fact classified.

If Trump said he declassified them all that would be doing the DOJ work. Why do that? Trump can then fight the declassification standing of each individual document.

I suspect it is not as easy to prove a document's classification status (if any) as people would assume.

You might not trust the coming 2023 MAGA house and senate. You might list 100 reason not to trust a MAGA house and senate, but you sure and fuck can't complain about the immediate utility of rescinding current uniparty draconian gun confiscation legislation.

I'd say defunding 87,000 armed IRS agents also has great immediate utility value.

You ever heard of utility value, or is that concept above your pay grade?

Thread title is fake BS - only delusional liberal fascists believe that lie

President Trump has previously stated very clearly that he declassified ALL of the documents in question.
That is an irrefutable FACT.

Just the facts.

Just because he said it doesn't make it true.

But he can declassify verbally as the president.

It would literally have to be true as a matter of fact.

However, all that's happening here is that the judge is not allowing the attorneys to know which specific documents were taken.

Of course the crooked FBI could have planted whatever they wanted.

But we all know which side you are on here.

Either you are with the people or the powers that be.

That's an irrelevant point since the judge won't let the attorneys know which specific documents they are talking about.

It would be irresponsible for them to just assume that nothing was planted.

This should be common sense. Simple reasoning and a small amount of critical thinking is involved, so good luck with that I guess.

What is the legal way for potus to declassify? Ask some clerk if its okay? Since there is no check on that power then he simply breathes it or maybe writes a memo but waits on nothing.

Yes it does. A president dosen't have to report to anyone in this matter. If he decides it's declassified, them it's declassified. Period.

Re: Judge asks Trump's lawyers if he really declassified the docs found at Mar a Lago. Trump won’t say.
This is a game and a set up going on.

They cannot give Trump's legal team a list of the documents.

If they received a list, Trump could literally say they are declassified and it would be over.

But since they won't or can't give them the list, they are making the Trump team declare the documents specifically.

They are damned if they do and damned if they don't because there could have been documents planted during the raid.

Of course we'd love to give the FBI the benefit of the doubt, but that would be unreasonable considering the circumstances around the ongoing Trump witch hunts.

Basically it's going to get interesting.

Either Trump's team will find a legal solution or they will hit a road block as obviously pre planned by the Dem witch hunters, and have no choice but to just put out the list of known documents that were there, knowing full well that this is an obvious set up that anyone with at least average IQ should see clearly if they weren't on drugs or a totally brainwashed zombie.

Yes, they are either so dirty that they planted shit, or they will fall flat with another fails, false investigation witch hunt against Trump.

Par for the course.

Either way what's to stop them? They've already pulled the heist, we're all just sitting around watching them light the fire.
