The Geneva sociologist and former SP is a member of the National Advisory Board of the UN Human Rights Council.

Actually, there should be an interview about his new book, which is the growing hatred of the Third World to the West theme. But Jean Ziegler can be in conversation with the French Webzeitung Rue89 also on the financial crisis - and represents a shocking claim is: "A Nuremberg Tribunal should condemn the crooks, which have caused the crisis." The illegal Iraq war is costing way more and actually killed millions of people, directly or inderectly. THAT is a much better reason to restart Nuremberg like trials.

The Seven Nuremberg Principles
[Paraphrased]


I. The initiating and waging of aggressive war is a crime.
Aggressive war is illegal.


The political, and military leaders of a government,
when they act in a political capacity,
who initiate and wage an aggressive war,
commit a crime against humanity
for which they may be tried by a duly constituted international tribunal.


Those who initiate and wage aggressive war must answer for the killings and devastation resulting therefrom to the extent of their participation in the perpetration and prosecution of the war.

Such leaders may not exculpate themselves by a plea that such killings and devastation are the incidents of war.
Military leaders who participate in political decisions
to wage such war forfeit their military immunity.




II. Conspiracy to wage war is a crime.

Leaders, organizers, instigators,
and accomplices participating in the formulation
or execution of a common plan to commit any act of aggressive war
or crime against humanity
are responsible for all acts performed by any person
in execution of the plan.


The crime of conspiring to commit aggressive war,
to be a separate crime,
must be closely related to the actual outbreak of armed conflict.



III. The violations of the laws or customs of war is a crime.

The concept of "total war" has not made obsolete the rules of humane warfare.

Total war does not justify absolute barbarity or utter devastation.

The killing of people and the destruction of property
must be related to justifiable military objectives.
Nothing may be done in war in the way of killing,
or mistreatment, or destruction which does not have a permissible military purpose.

Prisoners of war may not be mistreated.



IV. Inhumane acts upon civilians in execution of,
or in connection with, aggressive war, constitutes a crime.


Not every mistreatment of a civilian population
is criminal in international law.
Only inhumane acts as are in execution of,
or connected with, aggressive war are crimes against the laws of nations.



V. Individuals may be held accountable for crimes
committed by them as heads of state.


Leaders of a government or a nation,
who formulate its policy and directs its actions
into channels which are criminal under international law,
are personally and individually responsible for such crimes.

They cannot plead that what they did was state,
rather than individual, action.

Crimes against international law
are committed by human beings, not by abstract entities.


Only by punishing individuals who commit such crimes
can the provisions of international law by meaningfully enforced.



VI. Individuals may be held accountable for crimes
committed by them pursuant to superior orders.


A subordinate civilian or military person
who is ordered to commit a crime against humanity
or a criminal act, when he or she has an opportunity to refuse
or to resign or both,
should refuse or resign and not commit the inhumane or criminal act,
if the act is of sufficient gravity,
even if he or she may be forced to make such a decision at his or her peril.



Only by holding individuals accountable for the consequences of their own acts,
even when carried out in pursuance of higher authority,
can war crimes against soldiers or civilians or both be restrained.

No individual may be permitted to cast of his or her moral and legal obligations simply by trying to hide behind the authority of some other person in a higher position.


Everyone with the power of moral choice cannot be permitted to avoid personal responsibility for an international crime by resort to claiming mere obedience to an alleged superior order.

That a person employed by government in any capacity was ordered to kill or torture in violation of the international law of war is not a legally valid defense to such acts if it was possible for such person to exercise a moral choice.



VII. An individual charged with a crime
under international law is entitled to a fair trial.


All persons accused of crime in international law
are entitled to a presumption of innocense.
This presumption may be overcome only by evidence
which establishes guilt beyond a reasonable doubt
in a meaningfully fair trial
that provides at least a modicum of due process of law,
per Western Civilization legal norms.

The rights of the accused must be meaningfully respected.
The accused must be provided with a meaningfully full and proper legal defense.

Any conviction must be entered upon convincing evidence of guilt, not mere suspicion or expediency or both.

Guilt must be determined upon evidence in accordance with law.

No reprisals may be lawfully taken against any individual before guilt is determined upon evidence in accordance with law.

and
Commentary


Point No. 1:

The United States, throughout the last century, during World War I, World War II, the Korean War, the Vietnam War, and many other lesser military conflicts, was a major participant in gut wrenching wars that consumed a nation's treasure in blood, money, raw materials, manufactured materials, pain, and agony, that helped to establish major new principles of International Law—seven of them.


Among these seven, two of the most significant ones are:

1) No nation shall ever again cross an international border,
uninvited, with arms and hostile intent and


2) "Don't blame me; I was just following orders"
may not be a viable legal defense to questionable conduct pursuant to one's "orders."




Point No. 2:

The United States was the champion of these new ideas, and it played the key, pivotal role in imposing these new ideas, as a matter of international law, against the Nazis, in Nuremberg, Germany, after the fact.

Restated, the United States invented this new "law" and imposed it against the Nazis after the Nazis were defeated.



Point No. 3:

Article I, Section 9, Clause 3
of the United States Constitution declares, in part,
"No... ex post facto law shall be passed."



Point No. 4:

An "ex post facto law" is one that is

A) passed after the fact that

B) makes criminal what was legal before an act was done or

C) increases the penalty or creates a new basis for legal liability for what was done before the new law was passed.



Point No. 5:

The primary purposes of the United States Constitution's ban against ex post facto laws are:

A) To require Governments and Government's Agents to obey the rules,

B) To help insure that Governments and their agents will not function arbitrarily
and make up "the rules" to suit their perceived needs or wants, and

C) To keep common folk from being oppressed by Governments and their agents that do not obey Government's own rules.



Point No. 6:

What Hitler and Nazi Germany did was egregious, despicable, intolerable, insufferable, and shockingly and unequivocally morally wrong.

However, a compelling argument can be made that it was also wrong of the United States to impose against Nazi Germany's surviving members a new law, invented, and imposed, after the fact—the now world famous "Nuremberg Principles."



Point No. 7:

The "Nuremberg Principles" are
compelling, sound, wise, prudent, moral, excellent, public policy.
They are an extremely worthwhile, solid addition to International Law.



Point No. 8:

Saddam Hussein was a brutal, harsh, cruel, merciless, dictator; however, a compelling argument can be made that the United States, when it attacked and invaded Iraq under the leadership of United States President George Bush II, violated a principle of International Law that it spent much of the last century to establish:

No nation shall ever again cross an international border, uninvited, with arms and hostile intent, period.



Point No. 9:

In this limited, albeit important, sense, the senior civilian leadership of the United States has, inexplicably, arguably, violated a key principle of International Law—the above specified "Nuremberg Principle."



Point No. 10:

Significantly, the United States has done all of the following:

A) It imposed the Nuremberg Principles against Nazis and Japan's surviving senior military leadership at the end of World War II,

B) It cited the Nuremberg Principles as legal and moral justification to resist Saddam in Kuwait in 1991,

C) It also imposed the Nuremberg Principles against those responsible for atrocities in the Balkans in this century, and

D) It invaded Iraq with arms and hostile intent, uninvited.



Point No. 11:

Since the United States is now the world's only super power, who is powerful enough to enforce the Nuremberg Principles against the United States?

England? France? Germany? Europe? Japan? China? India? Russia? Costa Rica? The world?
The unorganized American Militia?



Point No. 12:

Any Government Agents in the United States who initiate force to disarm the peaceful, armed U.S. citizenry will, in the judgment of many such armed U.S. citizens, be guilty of violating "the Nuremberg Principles."



Point No. 13:

Those Government Agents who will attempt to disarm the armed U.S. citizenry will attempt to enforce an unconstitutional, unlawful, order, in violation of the United States Constitution and the Nuremberg Principles.



Point No. 14:

The armed U.S. citizenry is the world's largest, latent, potentially, most powerful guerrilla force in waiting. Anyone who doubts that is begging for a lesson in Triggernometry 101.



Point No. 15:

Only a damn fool up to no damn good would dare to issue an order, or attempt to enforce an order, to disarm the armed U.S. citizenry.



Point No. 16:

No other people on the face of planet Earth enjoys as much Freedom as do armed U.S. citizens. Is this a mere correlation [armed citizens with maximum Freedom] or is there a cause and effect relationship at play?

I believe there is a cause and effect relationship.

Government's Agents must treat an armed man as a citizen, with rights, and the pragmatic power to terminate the Government Agent's mortal existence.

A disarmed man, however, can be treated as a pissant, with immunity. An armed man, skilled in arms, can hold Perfumed Princes and Princesses accountable and deter them from governing oppressively, by killing them if necessary.

An Armed American Citizenry can deliver a comeuppance via a lesson in Triggernometry 101 that should bring any Tyrant Wannabee back to reality.


The reality is this:

The Armed American Citizenry does not have to

A) cross an ocean, a desert, a mountain range, or a continent to have access to, and to get within lethal range of, any domestic oppressor,

B) does not have to possess nuclear weapons or stealth technology to throw off an oppressor's chains, and

C) does not have to defeat the U.S. Armed Forces to terminate a leadership that rule oppressively.



Point No. 17:

If left no alternative, the armed U.S. citizens who surrender their arms, bullets first, will enforce the Nuremberg Principles, successfully, and they will defeat the combined military might of the U.S. Armed Forces, the Reserves, the National Guard, the Air National Guard, the police, and augmenting forces from the United Nations, in a snarly, brutal, new, United States civil war.



Point No. 18:

An accurate, clear, brief, understandable statement of the entire "Nuremberg Principles," based on an authoritative source, is stated below.

These principles are faithfully paraphrased below in easily comprehensible language.



Point No. 19:

Everyone is well advised to

A) Know the Nuremberg Principles and

B) Obey them.




Point No. 20:

I predict this: Anyone who issues or signs an order ordering anyone to disarm the armed U.S. citizenry will ultimately be deemed to have violated the Nuremberg Principles, and the United States Constitution, and they will be held accountable, will be tracked down, and will be treated like a rabid, treasonous, dog.



Point No. 21:

I further predict this:
Governments' Gun Grabbing Goons will come, many will be reduced to maggot meat, and the eventual outcome will be a new birth of Freedom under a re-vitalized Constitutional Rule of Law where individual rights are taken seriously and enforced, including the individual right to arms for lawful self-defense, defense of others, defense of community, defense of state, and defense of nation.

America's financial system has become "ENRONNED" by criminals in the markets, regulatory agencies,and the
banking industry.

The fraud extends so wide and deep ,and the incompetence and ignorance is so entrenched in the ranks of the Federal government at all levels, that the entire global financial system has been stressed to the breaking point.
