An onslaught of international lawsuits against Israeli officials alleging war crimes against the Gaza population during the operation has been widely anticipated. According to a Defense Ministry statement released Friday, the resolution will be discussed in Sunday's cabinet meeting. It was put together by the Defense Ministry, Ministry of Justice and State Prosecutor. Speaking on Friday, Barak said, "The Israeli government bears the responsibility for sending IDF troops on missions, as well as for defending civilians, and as such is obligated to grant its full support." He added that no harm should come to officers and soldiers as a result of their involvement in the operation. The defense minister also extolled the morality of the IDF, saying "the IDF is a moral army, and I don't know of any [other] army which operates to such high standards." He went on to say, "There is no place for automatic backlash at the end of every operation." Barak has also ordered the IDF to set up a team of intelligence and legal experts to collect evidence related to operations in the Gaza Strip, which could be used to defend military commanders against lawsuits. In related news, Prime Minister Ehud Olmert on Thursday assembled a special team, headed by Justice Minister Daniel Friedmann, to deal with possible lawsuits. The team will be comprised of representatives from the Prime Minister's Office and the ministries of Foreign Affairs, Defense and Justice, and will include experts on international law. The decision came in the wake of an assessment by Attorney-General Menachem Mazuz that Israel would have to deal with a slew of lawsuits. Friedmann was expected to convene the panel in the coming days. Mazuz's prediction seemed increasingly pertinent Thursday evening, when Richard Falk, an independent UN rights expert, said there was compelling evidence that Israel breached basic humanitarian rules and the laws of war by conducting a large-scale military operation "against an essentially defenseless population." "There needs to be an investigation carried out under independent auspices as to whether these grave breaches of the Geneva Conventions ... should be treated as war crimes," Falk said. On Wednesday, the IDF censor issued new orders forbidding the media from publishing the names or photographs of officers between the rank of company commander and battalion commander who participated in Operation Cast Lead out of concern that international war crimes lawsuits might be filed against them. The officers can only be identified by the first letter of their name and their unit. In 2005, Maj.-Gen. (res.) Doron Almog, former OC Southern Command, avoided arrest at London's Heathrow Airport. He was warned not to disembark from his El Al flight as British detectives were waiting to arrest him for allegedly ordering the demolition of Palestinian homes in Gaza in 2002. In 2006, then-Gaza Division commander Brig.-Gen. Aviv Kochavi, who was scheduled to study at the Royal College of Defense Studies in London, was warned by an IDF judge that he could be arrested upon arrival. At a press conference held in Geneva, Ging said that a credible investigation of the death and destruction in Gaza was necessary especially in light of the growing anger of Gazans, the increasing number of extremists in the Strip and their lack of faith in the rule of law, Reuters reported. It is urgent to establish accountability for death and the destruction of Palestinian infrastructure through a credible mechanism which would "channel this emotion to confidence in the rule of law," Ging reportedly said Ging told reporters that the number of extremists in the Strip had grown as a result of the three-week operation against Hamas, and stressed that it was important to prove that justice could be delivered in a lawful way. The extremists "are very confident in their rhetoric that there should be no expectation that justice will be delivered through the rule of law. Now we must prove that wrong," he reportedly said. According to the report, the UNRWA head noted that Israeli civilians had also suffered, and therefore, the investigation had to examine "legitimate allegations" on both sides. Ging expressed his hopes that new US Middle East envoy George Mitchell will talk to ordinary people in Gaza as part of a "new track" in diplomacy. "My first request to the US administration is talk to the ordinary people in Gaza. Khaled Abed Rabbo said Amal, aged two and Suad, seven, were killed by fire from the soldier's semi-automatic rifle. His third daughter, Samer, four, has been evacuated to intensive care in a Belgian hospital after suffering critical spinal injuries which he said were inflicted in the attack early in Israel's ground offensive. Mr Abed Rabbo stood near the wreckage off his subsequently destroyed home on the eastern edge of the northern Gaza town of Jabalya yesterday and described how a tank had parked outside the building at 12.50pm on 7 January and ordered the family in Arabic through a megaphone to leave building. He said his 60-year-old mother had also been shot at as she left waving her white headscarf with her son, daughter in law and her three grandchildren. "Two soldiers were on the tank eating chips, then one man came out of the tank with a rifle and started shooting the kids," Mr Abed Rabbo, who receives a salary as a policeman from the Fatah-dominated Palestinian Authority in Ramallah said. The family say they think the weapon used by the soldier was an M16 and that the first to be shot was Amal. Mr Abed Rabbo said that Suad was then shot with what he claimed were 12 bullets, and then Samer. The soldier who fired the rifle had what Mr Abed Rabbo thought were ringlets visible below his helmet, he said. The small minority of ultra-Orthodox Jews who serve in the army are in a unit which did not take part in the Gaza offensive and only a very small number of settlers who also favour that hairstyle serve in other units. Khaled Abed Rabbo said that there had been a delay before the ambulance could reach the building because the road from the west had been made impassable by the churning of the tanks. The soldiers had in the end let the family leave on foot, he said. He added that they walked two kilometres before finding a vehicle to take them to Kamal Adwan Hospital. He said: "I carried Suad, who was dead, my wife carried Amal and my brother Ibrahim carried Samer." He added: "We are not Hamas. My children were not Hamas. And if they were going to shoot anyone it should have been me." He added: "I want the international community and the International Red Cross to ask Israel why it has done this to us. They talk about democracy but is it democracy to kill children? What did the kids do to them? What did my house do to them? They destroyed my life? Another interesting point there was a post regarding children and brain injuries in hospital with Drs. indicating the wounds were sustained from shots fired in close proximity I wouldn't put it past those cowards (HamAss) to infact have fired these shots themselves. Their philosophy is everyone is expendable except them of course. |
