In an astonishing power grab, the Internal Revenue Service wants to license all who prepare returns for taxpayers. This means that Uncle Oscar couldn’t help his nephew prepare his income tax return unless a Washington bureaucrat grants a license.

H&R Block and the National Association of Tax Professionals (NATP) are supporting the effort by IRS Commissioner Douglas Shulman for selfish reasons: If Uncle Oscar can’t help, his nephew must pay a “licensed” preparer.

Shulman said in testimony before the House Ways and Means Committee that he expects to make his recommendations to Treasury Secretary Timothy Geithner and President Obama by the end of the year.

Shulman argued that licensing is needed because of bad guy tax preparers. Of the millions of tax returns filed over the last three years, only about 350 preparers were convicted of fraud, according to the IRS’s own records.

Ryan Ellis, tax policy director at Americans for Tax Reform, challenged IRS claims that licensing would generate significant funds from “tax cheats.” He told the Washington Times, “If the IRS thinks that licensing tax preparers will raise a lot of money, it won’t.”

Shulman’s recommendations “could focus on a new model for the regulation of tax return preparers; education and training of return preparers; and enforcement related to return preparer misconduct,” the IRS said.

“Education” and “training”? Many times over the years, newspapers have sent male and female reporters, posing as married couples, to IRS offices for “help” with their returns. They would offer simple situations: two kids and a mortgage. In an overwhelming majority of cases, four different IRS “professionals” would prepare their returns in four different ways.

Shulman said 87 percent of taxpayers now use computer software or paid preparers. “Tax preparers and the associated industry can help us increase compliance and strengthen the integrity of the tax system,” Shulman said. On the subject of “integrity,” he failed to mention David Rockefeller and other billionaires who pay no income tax at all by ducking their obligations with the help of high-priced “preparers.”

The first step in the licensing process, the IRS said, will involve fact-finding
and receiving input from unlicensed tax preparers and software vendors, as well as those who are licensed by state and federal authorities, including enrolled agents, lawyers and accountants.

“H&R Block strongly supports the IRS initiative announced by Commissioner Doug Shulman to review comprehensively alternatives for improving the accuracy of tax filings and the ethics and integrity of all who hold themselves out directly or indirectly in providing tax preparation services,” said Chairman Richard Breeden.

“We are all in favor of raising the bar,” said NATP’s Paul Cinquemani. “If people are operating out there without continuing education, they are on dangerous ground.”

This makes me sick. Force people to go to these tax preparers and they can in turn slip some money under the table to the politicians.

Many years ago they promised to make the tax forms so simple that a 3rd grader could do them. Still waiting for that.

And why do we have to fill all these tax forms out anyways when a national sales tax would be much better and no one could avoid paying taxes? And the people that are forced to fill these tax forms out should be able to charge the government for their time and labor because if you are forced to work for free without being paid then its called slavery.

IRS Provides Interim Whistleblower Guidance

In the spirit of the season, the IRS today announced interim guidance on how taxpayers can report violations of the tax law and claim a reward based on the amount of additional tax, penalties and interest that is owed:

Since the Whistleblower Office was created in December 2006, the IRS has received about 80 claims, half of those submitted in just the last two and a half months. To make a claim, an informant must file new Form 211, Application for Award for Original Information, which asks informants to provide an estimate of the tax owed, the pertinent facts in the case and an explanation of how the informant obtained the information.

The IRS’ Whistleblower Office will make the final determination about whether an award will be paid and the amount of the award for claims that it processes. Awards will be paid in proportion to the value of information furnished voluntarily with respect to proceeds collected.

Under the new procedures, the amount of award will be at least 15%, but no more than 30%, of the collected proceeds in cases in which the IRS determines that the information submitted by the informant substantially contributed to the collection of tax. The award percentage may be reduced in some circumstances, which are described in IRS guidance.

To be eligible for an award under the new procedures, the tax, penalties, interest, additions to tax, and additional amounts in dispute must exceed $2 million for any taxable year and, if the taxpayer is an individual, the individual’s gross income must exceed $200,000 for any taxable year in question.

i worked for the irs in the mid 80z. theres was nothing that said you cant pay your employees in gold/silver.

the irs also refused to show us auditors the code that says ppl must pay income tax. they just said it was the law but wouldnt show it to us in writing. we couldnt find it anywhere.

We should first demand an accounting of every fund and special interest group spending our US Taxpayer dollars. Every cent paid in should be accounted to to the public. All of the Recent bailout funding should be accounted for to the dollar and followed and continuously accounted for. That would and should be done by licensed professionals, first, befor individuals should be formally hassled. I think that is a resonable request. Every dollar brought in by the IRS, should be accounted for publically. Hows that? Lets license their our auditors for them.
How do we go about doing that first. I think that is very much more important. Aren't there like billions of dollars unaccounted for?

I know it says-"and the FG shall have the right to levy taxes" but I think there is a qualifier
in there

IRS- They may have won a few-but when it gets to the nitty gritty-and the Judge finally says to the IRS "Well-put up or shut up" they will always drop their cases

1. costs more. everyones gettn denied. those extra fees not returned.
2. get a loan before you file - they'd loan 500 right? fuckin 75/80 was the fee. if you got the 300 loan the fee was still 75/80.
