"If you think about vaccinating kids, schools are the logical place," Sebelius told The Associated Press. Last week the World Health Organization formally declared the swine flu a pandemic, meaning it is now spreading throughout the world unchecked. The U.S. has not made a formal decision on how to vaccinate millions of Americans against the flu, although money is being poured into developing a vaccine for the strain. Currently the swine flu doesn’t appear to be any more harmful than regular flu, which kills 36,000 Americans each year, although scientists do fear that the strain has the potential to develop into a much more serious flu. According to the WHO, nearly half of the 160 people who have died from swine flu have been young and healthy. That could mean school-age children would be the first priority to receive vaccinations, said Sebelius. Schools have teamed up with health officials in the past to provide flu vaccinations, although the event is rare. Last fall, 140 schools scheduled flu vaccinations for students, and some offered them to entire families. According to Sebelius, meeting President Barack Obama’s top healthcare priority of covering the uninsured could take until 2012 to implement, even if it Congress passes legislation this fall. Implementing the new programs is estimated to cost over $1 trillion over 10 years. The administration also plans to eliminate health disparities between minority groups and whites. According to Sebelius, the most severe disparities are found among American Indians . She pledged to reverse this "a historic failure of the government," saying the U.S. must provide free health care on reservations, and give the Indian Health Service the funds it needs. Sebelius faces the question of whether to push forward with swine flu vaccinations this fall in edition to the annual winter flu vaccination. Communication on who needs which, or both, vaccines will be a key challenge. She will soon call together state governors to see that the summer is used to prepare for the possibility of a severe flu season, instead of being “used as vacation months.” "We can always sort of back off" if the new flu fades away, she said, "but we can't wait til October hits and say, 'Oh my heavens, what are we going to do?'" In 1976, a mass vaccination against a different swine flu occurred, but was spoiled by reports of paralyzing vaccine side effects. The Food and Drug Administration will thoroughly test for swine flu vaccine safety, Sebelius said. U.S. Northern Command, which has primary responsibility for the homeland security mission, developed a communications plan (COMPLAN) for responding to a pandemic in December 2007. Elements of the directive were rehearsed four months later, according to Mike Kucharek, a command spokesman. Kucharek stressed that NORTHCOM has not been formally tasked to support the federal response to the flu outbreak. But he said that there is “significant” on-going coordination between staff officers at the command, and their counterparts at other federal agencies, including the Department of Homeland Security and the Department of Health and Human Services. Air Force General Victor Renuart, the NORTHCOM commander, has also been getting regular updates on the flu outbreak, according to Kucharek. He said that Renuart and his staff are monitoring the situation and “standing by to support”—if the need arises. Designated COMPLAN 35-91, the document outlines actions the command would take in response to a pandemic, as directed by civilian authorities. Kucharek said the plan was based on a massive flu outbreak affecting the United States. NORTHCOM personnel practiced portions of the COMPLAN in April of last year, during an Ardent Sentry homeland security exercise. Mr. Kucharek emphasized that the flu response drill represented only a small portion of the exercise, which tested the national response to both natural disasters and terrorist attacks. He did not say if the flu pandemic in last year’s exercise simulated a natural outbreak, or a bio-terrorism attack. Kucharek described the 2008 drill as a “table top exercise,” run internally at NORTHCOM headquarters at Petersen AFB, Colorado. Details of the military plan were released as the number of swine flu cases increased in both Mexico and the United States. At least 2,000 people in Mexico have been infected with the virus; 149 have died. The number of reported flu cases in the U.S. is far lower, but rising. Figures from the Centers for Disease Control indicate that 49 Americans have contracted the illness, but none have died. Cases have been confirmed in at least four states, Texas, California, New York and Ohio. In response to the outbreak, the World Health Organization raised its alert level, but stopped short of declaring a global emergency. The WHO alert system is now at Phase Four, meaning there is sustained human-to-human transmissions of the virus, sustaining the outbreak. Elevating the alert level to Phase 5 would represent an even wider transmission of the disease; the highest level, Phase 6, represents a full-blown pandemic. Kucharek did not say at what point the command might be tasked to assist in the federal response. The NORTHCOM spokesman said there are various “triggers” that would lead to implementation of the plan, while noting that none of the activation criteria have yet been met. Under the current plan, NORTHCOM elements could provide a range of wide range of support to federal, state and local officials. While declining to discuss specifics, Mr. Kucharek said potential missions might include medical and logistical support. NORTHCOM officials say they could also establish regional task forces or set up a mobile command element to direct military support efforts. The command controls a variety of air and land forces for possible homeland security tasking, most notably the 1st Brigade Combat Team of the 3rd Infantry Division. Based at Fort Stewart, Georgia, the 1st BCT began a one-year rotation last fall as the “rapid reaction” force of Army North, the ground element of NORTHCOM. The assignment marked the first time that an active duty Army unit was given a dedicated assignment to the command. While the brigade combat team has trained for various homeland security missions, there has been no change in their alert posture, according to NORTHCOM. Kucharek, the command spokesman, refused to speculate about a possible NORTHCOM role in the federal response. At the Pentagon, officials were also monitoring the situation, but said there were “no immediate plans” to release anti-viral drugs from its stockpile. Defense Department spokesman Bryan Whitman told reporters that the first priority is to monitor the health of the force, to ensure the military can perform its assigned missions. The “North American Plan for Avian & Pandemic Influenza” was finalized at the SPP summit last week in Montebello, Quebec. At the same time, the U.S. Northern Command, or NORTHCOM, has created a webpage dedicated to avian flu and has been running exercises in preparation for the possible use of U.S. military forces in a continental domestic emergency involving avian flu or pandemic influenza. With virtually no media attention, in 2005 President Bush shifted U.S. policy on avian flu and pandemic influenza, placing the country under international guidelines not specifically determined by domestic agencies. The policy shift was formalized Sept. 14, 2005, when Bush announced a new International Partnership on Avian and Pandemic Influenza to a High-Level Plenary Meeting of the U.N. General Assembly, in New York. The new International Partnership on Avian and Pandemic Influenza was designed to supersede an earlier November 2005 Homeland Security report that called for a U.S. national strategy that would be coordinated by the Departments of Homeland Security, Health and Agriculture. The 2005 plan, operative until Bush announced the International Partnership on Avian and Pandemic Influenza, directed the State Department to work with the WHO and U.N., but it does not mention that international health controls are to be considered controlling over relevant U.S. statutes or authorities. Under the International Partnership on Avian and Pandemic Influenza, Bush agreed the U.S. would work through the U.N. system influenza coordinator to develop a continental emergency response plan operating through authorities under the WTO, North American Free Trade Agreement and the U.N. Food and Agriculture Organization. WND could find no evidence the Bush administration presented the Influenza Partnership plan to Congress for oversight or approval. The SPP plan for avian and pandemic influenza announced at the Canadian summit last week embraces the international control principles Bush first announced to the U.N. in his 2005 International Partnership on Avian and Pandemic Influenza declaration. The SPP plan gives primacy for avian and pandemic influenza management to plans developed by the WHO, WTO, U.N. and NAFTA directives – not decisions made by U.S. agencies. The U.N.-WHO-WTO-NAFTA plan advanced by SPP features a prominent role for the U.N. system influenza coordinator as a central international director in the case of a North American avian flu or pandemic influenza outbreak. In Sept. 2005, Dr. David Nabarro was appointed the first U.N. system influenza coordinator, a position which also places him as a senior policy adviser to the U.N. director-general. Nabarro joined the WHO in 1999 and was appointed WHO executive director of sustainable development and health environments in July 2002. In a Sept. 29, 2005, press conference at the U.N., Nabarro made clear that his job was to prepare for the H5N1 virus, known as the avian flu. Nabarro fueled the global fear that an epidemic was virtually inevitable. In response to a question about the 1918-1919 flu pandemic that killed approximately 40 million people worldwide, Nabarro commented, “I am certain there will be another pandemic sometime.” Nabarro stressed at the press conference that he saw as inevitable a worldwide pandemic influenza coming soon that would kill millions. He quantified the deaths he expected as follows: “I’m not, at the moment at liberty to give you a prediction on numbers, but I just want to stress, that, let’s say, the range of deaths could be anything from 5 to 150 million.” In a March 8, 2006, U.N. press conference that was reported on a State Department website, Nabarro predicted an outbreak of the H5N1 virus would “reach the Americas within the next six to 12 months.” On Feb. 1, 2006, NORTHCOM hosted representatives of more than 40 international, federal and state agencies for “an exercise designed to provoke discussion and determine what governmental actions, including military support, would be necessary in the event of an influenza pandemic in the United States.” NORTHCOM and other governmental websites document the growing role the Bush administration plans for the U.S. military to be involved in continental domestic emergencies involving health, including avian flu and pandemic influenza. NORTHCOM participated in a nationwide Joint Chiefs of Staff-directed exercise – code-named Exercise Ardent Sentry 06 – to rehearse cooperation between Department of Defense and local, state and federal agencies, as well as the Canadian government. A pandemic influenza crisis was one of the four scenarios gamed in Exercise Ardent Sentry 06, involving a scenario of a plague in Mexico reaching across the border into Arizona and New Mexico. As has been customary in SPP documents and declarations, the Montebello, Canada, announcement of the North American Plan for Avian & Pandemic Influenza acknowledges in passing the sovereignty of the three nations. The announcement says, “The Plan is not intended to replace existing arrangements or agreements. As such, each country’s laws are to be respected and this Plan is to be subordinate and complementary to domestic response plans, existing arrangements and bilateral or multilateral agreements.” Still, the SPP plan argues the risk from avian and pandemic influenza was so great to North America that the leaders of the three nations were compelled “to work collectively and with all levels of government, the private sector and among-non-governmental organizations to combat avian and pandemic influenza.” Moreover, the SPP plan openly acknowledges, “The WHO’s international guidance formed much of the basis for the three countries’ planning for North American preparedness and response.” WND previously reported NORTHCOM has been established with a command center at Peterson Air Force Base, tasked with using the U.S. military in continental domestic emergency situations. WND also has reported President Bush signed in May two documents, National Security Presidential Directive-51 and Homeland Security Presidential Directive-20, which give the office of the president extraordinary powers to declare national emergencies and to assume near-dictatorial powers. Following the Montebello summit last week, the SPP North American Plan for Avian & Pandemic Influenza was published on a made-over SPP homepage redesigned to feature agreements newly reached by trilateral bureaucratic working groups. Bob Filner, a California Democrat, introduced H.R. 675. The bill would amend title 10 of the United States Code and extend to civilian employees of the Department of Defense the authority to execute warrants, make arrests, and carry firearms. The bill was referred to the Armed Services Committee on January 26, 2009. Rep. Bob Filner Filner’s bill would amend the United States code with the following: “Sec. 1585b. Law enforcement officers of the Department of Defense: authority to execute warrants, make arrests, and carry firearms… for any offense against the United States.” (Emphasis added.) The Posse Comitatus Act, passed on June 18, 1878 after the end of Reconstruction, limits the powers of the federal government to use the military for law enforcement. The Act prohibits members of the federal uniformed services from exercising nominally state law enforcement, police, or peace officer powers that maintain “law and order” on non-federal property within the United States. H.R. 675 sidesteps Posse Comitatus by defining “law enforcement officer of the Department of Defense” as “a civilian employee of the Department of Defense,” including federal police officers, detectives, criminal investigators, special agents, and game law enforcement officers classified by the Office of Personnel Management Occupational Series 0083 (the United States Office of Personnel Management is described as an “independent agency” of the U.S. government that manages the civil service of the federal government). In 2005, the Office of Personnel Management partnered with the Department of Homeland Security to create a “21st century human resources management system that fully supports the Department’s vital mission,” according to then Office of Personnel Management Associate Director for Strategic Human Resources Policy Ron Sanders. At approximately the same time, the DoD issued a Defense Directive 1404.10 (read PDF) that establishes a “DoD Civilian Expeditionary Workforce” and rescinds a prior Clinton era directive dealing with the emergency use of civilian personnel. The Obama administration describes the Civilian Expeditionary Workforce as follows: Members of the DoD Civilian Expeditionary Workforce shall be organized, trained, cleared, equipped, and ready to deploy in support of combat operations by the military; contingencies; emergency operations; humanitarian missions; disaster relief; restoration of order; drug interdiction; and stability operations of the Department of Defense in accordance with DoDD 3000.05 “This new directive is odd, coming as it does after campaign promises by Obama to establish a paramilitary ‘civilian national security force that’s just as powerful, just as strong, just as well-funded’ as our military,” writes Doug Ross. According to Sec. Def. Robert Gates, defeating terrorism will require the use of more “soft power,” with civilians contributing more in communication, economic assistance, political development and other non-military areas. “Gates called for the creation of new government organizations, including a permanent group of civilian experts with a wide range of expertise who could be sent abroad on short notice as a supplement to U.S. military efforts. And he urged more involvement by university and other private experts,” the Associated Press reported in late 2007. It should be noted that the original Civilian Expeditionary Workforce directive mentions the term “overseas” no fewer than 33 times, while the Obama revision does not mention “overseas” at all. In other words, the revised directive is designed for “emergency operations” in the United States. Both H.R. 675 and the DoD Civilian Expeditionary Workforce directive will establish civilian “soft power” under the direction of the Pentagon. Obama is now actively working to create a paramilitary “civilian national security force that’s just as powerful, just as strong, just as well-funded” as the military. In order to skirt Posse Comitatus, Obama’s paramilitary brownshirts will be organized and run out of the Office of Personnel Management with orders coming from the Pentagon. In the recent past, the Pentagon sent operatives to snoop on anti-war and patriot demonstrations — for instance, Alex Jones’ protest at the Federal Reserve was monitored by the Pentagon . The editor of the popular blog “Pissed Off Former Democrat” phoned the legal council at the Arkansas State Health Department to seek advice about obtaining waiver forms for a future mass swine flu vaccination program. One of his main concerns centered around the fact that the company chosen to mass produce the swine flu vaccine, Baxter International, were recently caught in a scandal after it emerged they had sent out vaccines contaminated with the H5N1 avian flu virus to 18 countries from their Austrian branch. It was only by providence that the contamination was found after the batch was first tested on ferrets in the Czech Republic, before being shipped out for injection into humans. The ferrets all died and the shocking discovery was made. Some Czech newspapers speculated at the time that Baxter was embroiled in a conspiracy to provoke a pandemic from which it would reap billions in profits from producing the vaccine to counter a bird flu outbreak. As we have previously covered, the last time the government ordered a mass vaccination drive in response to a swine flu outbreak, the program had to be stopped short after the shots caused over 500 cases of Guillain-Barre syndrome, a severe paralyzing nerve disease. 30 people died as a direct result of the vaccinations. During the phone conversation, the legal council discusses the potential of a future mandatory swine flu vaccination program and states, “That’s constitutional, there’s no doubt about it….mandatory vaccinations are legal under the Supreme Court….absolutely.” The caller responds, “I’m an American and I have a legal right to make my own decision whether or not someone sticks a needle in me,” to which the legal council responds, “That’s not true….no.” “As a lawyer you believe that I don’t have the right to deny a vaccination,” asks the caller,” to which the legal council responds, “Absolutely….I don’t know why you have a problem with that….mandatory vaccines are constitutional,” adding that it doesn’t matter about personal or religious objections. The caller then asks how the mandatory vaccine would be enforced by law, “for example somebody sticking a gun in my face,” to which the legal council responds, “you could be held liable.” (ARTICLE CONTINUES BELOW) The legal council at the Arkansas State Health Department cites the 1905 Supreme Court case of Jacobson v Massachusetts to argue that governments can force citizens to take vaccines. Less than 50 years before, in Dred Scott v. Sandford, the Supreme Court also ruled that black people were slaves - property of their slaveowners with no inherent rights whatsoever. 22 years after Jacobson v Mass., in Buck v Bell, the Supreme Court also ruled that people designated “feeble-minded” by the government could be sterilized. The fact that the Supreme Court made a ruling over 100 hundred years ago saying the government could inject people by force doesn’t make it morally or constitutionally justifiable. To stick needles in people at gunpoint by government decree is blatantly unconstitutional under any reasonable definition of basic human rights or the freedoms enumerated by the founders in the constitution itself. American Indians were rounded up and sent to death camps under legal orders, but that didn’t make it right or justifiable. Hitler’s mistreatment of Jews, Gypsies, political dissidents, homosexuals and others who resisted government policies imposed during times of “emergency” in Nazi Germany was all perpetrated behind a thin veil of legality, but that didn’t make it right either. As a member at the Prison Planet Forum points out, “Tyrannical evil loves to mask itself in the robes of righteousness, to justify itself with legal documents, to trample the very ideas of what Law and Right mean. Resisting that evil, rising against that tyranny, by saying No More. That is right.” As we previously reported, Time Magazine has been preparing Americans to accept the idea of mandatory vaccinations, reporting on April 28th that a mass vaccination program is being readied to combat swine flu while also urging Americans to “trust that the government is working for the greater good” and to not resist draconian measures. To refuse the inoculation is a felony. We should all refuse to take this deadly eugenic poison. Baxter who has been caught mixing weaponized flu in their vaccines, has been given the contract to manufacture vaccines for the current swine flu.
