NEW MARKET (WATE) -- For the first time, New Market property owners are talking about offers from a company that wants to buy their land for a proposed rail facility.

Norfolk Southern wants to locate its intermodal rail facility and logistics facility along Highway 11E in New Market, using it to move cargo between trains and trucks.

The company has the option to acquire the land through eminent domain if property owners refuse to sell.

Mike Clabough is one of several people who say they're not willing to sell.

He got an offer in June. "That was just junk mail to me."

The land was a present from his mother after he retired from the Navy. Clabough had planned to stay there for the rest of his life, tending to his cattle and rebuilding antique cars.

"I don't really care to read this because I thumbed through the back of it where it says I need to sign right here and I'm the seller," Clabough says.

The listed buyer is Newmarket 11E L.L.C., a title he says Norfolk Southern is using as it tries to buy up land to make room for a proposed intermodal rail facility and logistics park set to open in 2013.

"I got a call from this real estate developer wanting to buy my property, the property that was Mama's, and we were in the process of reading the will," says Frank McGhee, one of Clabough's neighbors.

McGhee has refused every request to have his land appraised. As he walked through his yard, old memories came to mind. That's the reason he's also unwilling to sell.

"Money don't mean nothing to me. It's just time I spent with my mother," McGhee says.

While McGhee admits worrying that Norfolk Southern will use its power of eminent domain to force him off his land, he's not willing to give up. He plans to fight back, along with many of his neighbors.

"I've been here for all my life. I guess they'll have to send a truck in to get me," McGhee says.

Norfolk Southern officials have said they've made offers on more than 20 pieces of property, but they refused to comment further.

Here in Ohio "THEY" bought the land some housing projects occupied and forced apartment complexes in all the surrounding cities to allocate a percentage of their units as section 8's to relocated the folks living in these housing units they bought out.


I didn't think this was fair considering the percentage of folks who are lazy low lifes.

if you can recall back in say 1999 the rails were near bankrupt. here in pa they were a pube away from shutting down.
the gov gave them a little help back then.

this administration however has been boosting the rails - looking to turn them into what great britain/europe has done.

now theyre looking to expand even it it be by eminent domain.
theres an untold story behind this, bc of how the economy is and how business' are closing/laying off - if this goes the way im thinking it is, it will bury the trucking industry.

i some what remember back on long island in the late 80s or very early 90s - mac arthur airport only could house 727's and they wanted to expand the airport to land larger planes so they needed to build one longer runway.

in ronkonkoma, i believe it was along expressway drive south, the residents were 'asked' to sell. they refused. now back then homes went for avg 120-130k. i think they were offered around 70-75k not certain. a fight ensued, town meetings etc.

bottom line - and it was in long island newsday - these people lost the fight. they took it to the end. they received no money and eminent domain forced them out by shutting the utilities off - mainly the water, once the water is shut off it becomes a 'health issue' - unfit for human habitation.

these people got fucked.

Private Developer starts paperwork to build ´Lost Liberty Hotel´ where Supreme Court Souter´s House is located.

Weare, New Hampshire (PRWEB) Could a hotel be built on the land owned by Supreme Court Justice David H. Souter? A new ruling by the Supreme Court which was supported by Justice Souter himself itself might allow it. A private developer is seeking to use this very law to build a hotel on Souter´s land.

Justice Souter´s vote in the "Kelo vs. City of New London" decision allows city governments to take land from one private owner and give it to another if the government will generate greater tax revenue or other economic benefits when the land is developed by the new owner.

On Monday June 27, Logan Darrow Clements, faxed a request to Chip Meany the code enforcement officer of the Towne of Weare, New Hampshire seeking to start the application process to build a hotel on 34 Cilley Hill Road. This is the present location of Mr. Souter´s home.

Clements, CEO of Freestar Media, LLC, points out that the City of Weare will certainly gain greater tax revenue and economic benefits with a hotel on 34 Cilley Hill Road than allowing Mr. Souter to own the land.

The proposed development, called "The Lost Liberty Hotel" will feature the "Just Desserts Café" and include a museum, open to the public, featuring a permanent exhibit on the loss of freedom in America. Instead of a Gideon´s Bible each guest will receive a free copy of Ayn Rand´s novel "Atlas Shrugged."

Clements indicated that the hotel must be built on this particular piece of land because it is a unique site being the home of someone largely responsible for destroying property rights for all Americans.

"This is not a prank" said Clements...

(We never heard further about Clements' success. :))

its weird i cant find ine thing on the net re macarthur airport and eminent domain re all those homes they 'took'. there was something like 100 residents involved. i even went back into newsday archives.
