There is not really any such thing as private property when it comes to land. People hold the right to land use by agreement with others through laws. The land will be there a long time after the current steward of it has passed on. In reality all land belongs to all people and the archaic laws that state that an individual can "own" land as "private" property will be repealed as all land is nationalized under the responsible usage laws that will be passed in the near future. The movement for social responsibility has the backing of all of the important unions, the executive branch of the US federal government as well as the more important political parties in the US and Europe, and all of the non-dominant parties in Canada.

This article is too confusing, is it a right of way or an easement? If an easement then the pipeline is existing as a privilege extended by the owner, if it is a right of way, then the workers had complete access, and I suppose Engelking could be trespassing on their right of way if he was threatening the crews. It was probably his attitude that got him into the mess, if he had approached with less hostility he may not have had to spend the night in the pokey. Lesson learned.
