OK, GLPers - I need educated opinions on these questions
MODS, I'm asking a huge favor - would you pin this for me for 'just a couple hrs.' so I can get some intelligent answers to my questions......please, please, please......just a couple hrs.?

I'll try to put it all in a nutshell- try.
18 months ago I had to have a stress test. Total $1360. I have no insurence and asked the heart assocation if I could make monthly pmts. They said (in writing) that it was ok as long as I made reg.monthly pmts.(nothing said about min pmts.)I made 30.00 a month pmts. (thats all I could afford)I have made pmts religiously every month and have proof of doing so.
Yesterday I received a letter from the heart ass. telling me that they appreciate that I have paid monthly pmts all along but, because they are not charging interest or monthly service fees that they are now going to give me 1 of 2 opitions to pay it-my balance ($635.00)off.
Quoating the letter." Increased cost of monitoring your account, generating and mailing statements has required us to contact you regarding your current payment arrangement."

these are my options:
#1: I can have a 50% discount on the balance, total being $317.50 (then it will be paid in full)and have 2 months to pay it off. Yes, great option IF I had the $158.75 to pay for 2 months.
#2: If the above is not feasible, they will have to increase my monthy pmts to $150.00/month until the $635.00 is paid in full.

They closed the letter with what I see as a threat - that if I do not call them within 7 days of recieving the letter to make a choice of the 2 opitions they will "BE FORCED to send my account to an outside collection agency to monitor my monthly pmts."

I have 3 question for you GLPers.and I"m asking those who actually know - not people who are guessing ---I can guess for myself..thanks

1- I've made regular monthly pmts, Can they sick a collections agency on me?

2- they now have me pissed off - I've been doing the right thing and paying it off monthly to the best of my ability - if I choose to say F-U and not pay anymore, can they put a lein on my home?

3- please explain what I percieve to be a threat. What kind of threat is the closing statement? And if I continue to send a pmt each month without them sending me a statement - am I still in trouble with the collections agency or anyone for that matter?

PS: I don't give a rats ass about my 'credit score' creditscores are bullshit any way. ( a friend of mine has always paid cash for everything his whole life and his credit score is lower than mine)credit scores are important to the people who want to steal our hard earned money, the govt., the banks, the big pharma, big corps. insurance companies, etc....
I just need some educated opinions......thanks to anyone who helps me out here. :)

As far as I know, they can't do this if you've made regular payments. It's a shame you can't make the $150.00 per month.

I would try to find someone to loan you the $317 and take the deal. Pay that person back at like $35 a month for 1 year.

Thats $420 and a 25% return for them, and you also save $215

Win-Win


Its really more like a 35% return for the loan.

By paying $30/month on a $1300 service, you basically stretched the payments out to what, 4 years????

With the value of the dollar dropping, they've already lost 25-30% of the value of the unpaid balance by 2010.

I think that paying only $30 per month is too little, given how long it stretched the payments out for and inflation due to the dollar dropping in value.

It's not worth it to them to let you continue with $30 payments.

There has to be a way for you to come up with the cash and take the deal. Being self employed and self insured I always make a deal for cash. Sell something, even blood if you have to. Take the discount and get the monkey off your back.

They can't lien your house.

You owe the money, so pay it.

If you continue the $30/month you may be harassed by a collection agency, and they will add fees to your bill.
Poor people do poor people things, and rich people do rich people things.

You cannot legislate the poor into prosperity by legislating the wealthy out of prosperity.

What one person receives without working for, another person must work for without receiving.

The government cannot give to anybody anything that the government does not first take from somebody else.

Within the 7-day time limit, write them a letter saying you have contacted an attorney who says they cannot do this and he will assist me with a lawsuit against them if they do not continue the previously-agreed arrangement.

Say you are sending the letter yourself so that you do not have to pay the attorney to do it and can instead continue making your $30/mo payment as previously agreed.

Put a CC: John Smith, Esquire, at the bottom of the page (any real attorney name you find in a phonebook will do.)

That might be enough to scare them off for such a tiny amount that you owe. Really, 600 is NOTHING in the medical world and medical billing office. They are jerking you around.

Do you have an account number to which your payments are being applied? If so I would continue to make your payments as you have putting the account # in the memo part of your check. What they are trying to tell you is that they are not in the credit business which flys in the face of their previous actions. If they turn it over to a collection agency you just tell the agent who calls you have made this months payment directly to the Heart Association and to take it up with them. If they try and tell you that you have to send payments to them (the collection agency) just tell them that you owe them nothing and will continue to deal directly with your creditor. They will persist you do the same. They cannot take your house but they could place a lien perhaps against it which is meaningless until you go to sell it. Although if you have been honest about your previous actions I doubt seriously they could lien the property either.

Not sure if they can do the collections thing or not, but I'm pretty educated in Real Estate dealings (broker's license & Manage a large property management company).

I know for a fact that they cannot put a lien on your house for a medical bill. If it was a carpenter that did work on your house, that would be a different story (mechanic's lien).

If possible, try to take the deal! That's a big savings for you!

FYI, in order to make "monthly payments", both parties must agree to the payment amount beforehand. So unfortunately, they can turn you in to a collection agency.
