A 14-year-old Okanagan member of the Jehovahīs Witness church has lost a bitter court battle against receiving blood transfusions.

B.C. Supreme Court Justice Mary Boyd ruled yesterday that a provincial court judge had the power to authorize emergency transfusions against the girlīs will.

Her lawyer, Shane Brady, said the girlīs family is "disappointed" and is considering taking the case to the B.C. Court of Appeal.

"The family is disappointed because their position has been, all along, that once the court has found that she is as capable as you and I, that young woman should make the decision," said Brady.

The girlīs name and her hometown canīt be revealed, due to a publication ban. She was not in court yesterday.

Brady said the girl believed transfusions were a "violation of the biblical command to abstain from blood. The decision is based on her religious conscience."

The girl was diagnosed in December with a cancerous tumour on her right leg. The tumour was removed and she began chemotherapy.

After the girl and her family refused consent for blood transfusions, the case was forwarded to B.C.īs director of Child, Family and Community Service.

In court documents, the girl described how a transfusion would contravene her religious beliefs.

"Itīs no different than somebody getting sexually assaulted or raped or robbed or something," she said. "Youīd feel violated because itīs not anybody elseīs property, itīs you."

Lawyers for the girl fought the case on the grounds the girl was not represented by legal counsel and that she was a "mature minor," capable of deciding her own treatment. They also said the girlīs Charter rights were infringed by provincial law and she had suffered age discrimination.

Boyd said yesterday that by March 15, the girlīs hemoglobin dropped to "well below" levels where a transfusion is normally given.

Boyd found that Provincial Court Judge Paul Meyers was "considered, thoughtful and sensitive" in ensuring the child had a fair hearing on March 18.

Boyd said doctors needed the "safety net" of having a transfusion available to continue with a more invasive cycle of chemo that the girl is due to start tomorrow. Meyers acted properly and "did everything possible to ensure the utmost fairness," said Boyd. That included talking to the girl by phone in her hospital bed.

Boyd said provincial laws allow courts to protect the rights of children in need of medical treatment. "All children are entitled to be protected from abuse and harm . . . the ultimate threat of harm would be death," she added.

Boyd said that while the girl was free to choose and practise her religion, that right was "not absolute" and orders could be made in a childīs best interests.

"Ultimately, her religious beliefs donīt override her right to life and health," Boyd said.

Raymond Busby, an elder in Burnabyīs Capital Hill Jehovahīs Witnesses congregation, said religious beliefs come first.

"The Bible has clear standards that we are not to take blood as Christians," he said.

This is a tough issue. On the one hand I have long resolved that I would fight to the death against anyone trying to hospitalize, treat or adminster medications against my will...

...But then these people are trying to refuse on horseshit religious grounds so that ends the arrgument right there.

That said if I were in that girlsī shoes letīs just say that there would be a lot of other people needing blood transfusions before they finally strapped me down.

Blood is big business and there are other options out there. Do the research. Anyway, they already are denying people their wishes in medical treatments and once they ignore religious reasons the sky is the limit. Get ready to say bye bye to any rights you thought you had.

There are several options verdus taking of the blood. It is more valid than even her religious beliefs. There are several factors in blood that cannot be screened for besides blood typing and antibody-antigen response. It is very involved and is an egregious ruling to many outside of the JW belief system. It is an assault in the truest sense of the word.

People do very well below the levels they have set to give transfusions.

Also, interesting that a girl of 14 is old enough without anyones consent to go and get an abortion which could kill her but is not old enough to say no to a medical treatment that really could cause her problems in the long run. But not matter, they are infringing on her religious beliefs. If she can explain her beliefs she is old enough to decide for herself.

Religious beliefs are not horseshit as you call them. They are deeply held personal beliefs. Arenīt people allowed their beliefs? Do you want someone deciding for you what your beliefs should be, religious or not? Do you want someone else deciding medical treatments for you? Frankly, religious beliefs are about the only thing guaranteeing freedom of speech or any freedoms these days. Once they are gone you will have absolutely no rights whatsoever. Even your īrightī to get on the internet and express your opinions will be gone. Your government will be able to do what they want to you when they want to.

The real reason is because the parents transfered title of this child to the Canadian government when they registered its birth. The government now has title/ownership of this child. That is why family child and services have more power than judges. The child does not belong to the parents. Take a look at any birth certificate. You wonīt find the parents as being the title holders. It is the province/state within which the child was born. They change the child into a "person" = corporation = ALL CAPITAL LETTER NAME.

False prophecies, brainwashing, threats..it's a cult in every sense of the word...

They even believe that a low-ranking angel was really Jesus Christ the son of God..chew on that for awhile.

You are absolutely right!! Mothers would be very wise to give birth at home and refuse to "register" the birth. As soon as you "register" something, you literally transfer ownership.

Unfortunately their governing body makes this decision for them. They have no free thought on the matter. Be forced not to have a transfusion by their god. Or be forced to have one by their government.

Too bad people let others make their decisions for them.

I believe one day Jehovah's witnesses will drop this whole blood problem and integrate into mainstream religion anyway.

I applied for my "live birth" registration and when it arrived, one thing really stood out. My mother was listed as the "INFORMANT." What is an informant? According to the Black's Law Dictionary:

"A person who informs or prefers an accusation against another, whom he suspects of the violation of some penal statute. An undisclosed person who confidentially volunteers material information of law violations to officers and does not include persons who supply information only after being interviewed by police officers, or who give information as witnesses during course of investigation."

Now, pray tell, how in the hell was I, at the age of 7 days (date of registration), able to be in violation of some punishable (penal) violation??? Can you now see just how sick and deranged your own government is under the control of TPTB?
