## TSA - A DEFENSE ATTORNEY WEIGHS IN. ### INFO FOR ALL FLIERS ##

Being frequent fliers, we contacted a defense attorney (who is a personal friend) to discuss our best options given the tyranny before us, and we discussed all the aspects from the policies being unconstitutional, to violating state Penal Codes, to policies being challenged by state legislators, to children, to assault vs. sexual assault, to radiation, to the borders being wide open, to protests, to appealing to representatives, to international procedures, ad nauseam.

Here's his advice:

If you choose civil disobedience to stand firm on your rights and either 1. get arrested or 2. have a federal civil suit filed against you, you will lose. 100% of the time. Everything is stacked against the citizen. Full stop.

The only gain: a trip to jail (if the feds decide to go that route and they most likely will to flex their muscles and start setting examples), a new record and your bank account will be lighter $11K plus attorney fees.

This, however, does give one standing because it is legal evidence you have been injured. Once you have been injured, you can challenge the law up through the courts and all the way to the Supreme Court if you are successful.

That said, my attorney advised to have, at minimum, several million FRNs on hand for the fight, unless, of course, you find an attorney willing to work pro bono for the "greater good". Mine does not happen to be such an attorney.

He did, however, provide further legal advice to achieve standing without getting arrested:

Prepare yourself for the experience by arming yourself with a camera phone fully charged and with full memory to record the experience. If you are fortunate enough to have someone traveling with you, have that person record the event. Turn on the camera and audio before sending it through the baggage xray and leave it on as Tyner did.

When approached to be groped, ask the agent to explain to you the procedure in detail. Respond by stating that you will comply but ONLY under protest and duress. Then follow with the reasons you are verbally protesting: violation of my 4th Amendment rights, violation of State Penal Code XX (it is 22.01 in Texas) and further make your case that you believe there are other more effective screening measures such as bomb sniffing dogs, puffer machines and even the Fed gov themselves as pre-screeners because they know who you are prior to your arrival and from your background you do not fit any terrorist profile and the fed gov AND TSA know that! He stated it was important to make the last statement.

Allow them the search and continue to state and repeat during the search that you are allowing this only under protest and duress. When they get to your nether regions and you feel violated, make that statement. Under state Penal code XXX, you have just assaulted me.

Video and/or audio evidence now gives you standing (because you have evidence of being injured) to bring a suit OR to join a class action suit to challenge the law without being arrested or without a civil suit brought against you. That said, unless you join a class action or secure a pro bono attorney, then you will need a bank of money for the road ahead.
