Under Article 1 section 8 of the U.S. constitution are enumerated powers of the U.S. congress.

The following are powers given to congress:

To coin Money, regulate the Value thereof, and of foreign Coin, and fix the Standard of Weights and Measures;

To provide for the Punishment of counterfeiting the Securities and current coin of the United States;

The Federal Reserve bank is creating coin with no oversight from the congress and should therefore be considered as counterfeit.
