An Ohio man who was out sick when his coworkers won a $99 million lottery jackpot hopes to have his lucky day in court.

Last month, 22 KraftMaid employees in Youngstown, Ohio who regularly pooled their money to buy lottery tickets won the Mega Millions draw, TV station WEWS reported. But one man, Edward Hairston, missed out on the big prize because he'd been on sick leave for three months and hadn't contributed his $5 to the pot in June, July and August, according to WCKN.

Wait a minute, he hadn't contributed to the pot for MONTHS? That changes everything for me. If he had missed the pot just one day because he wasn't physically present to contribute, that is different than him not even participating for months. I think he will lose this one.

he missed for three months without paying. he could have very easily set up some arrangements if he wished to continue to contribute in hopes of winning. if it were my company, we would probably give the guy his share. but who knows, maybe this guy was a dick

It depends on how long he had contributed in the past. If he had contributed for more than a year in the past, and was out sick due to a relatively serious illness he should be entitled to 60-90% of his share imo.

I vote no because he was on leave for 3 months. It's not like he was a contributor last week and every week before that, but this week he was out Wednesday so screw him. No, he was out for the last 3 months and wasn't contributing, which means no dice.

he may have a case, but i feel 'no freakin way' because of the precedent this may set for future cases of this kind. he should have sent his $5 a month in to a co-worker each month.

Precedent already exists for cases like these. There is a reason that lotto corps now have group play tools/forms/advice etc (in Canada at least). If he had been in with a set group for a long time and there was no formal "removal" from that group then courts have said he is still a part of the group.

This doesn't hold true if the group changes on a draw to draw basis. The way I understand it, courts focus more on the makeup of the group rather than who paid who when.

Not that I agree with it entirely but I can see that viewpoint. What if the person responsible for buying the tickets was sick for a week, bought the ticket before collecting money from the group... and that ticket won? That person could claim "Nobody paid me, its mine." when clearly it was purchased for the group. There are gray areas.

His guess is that they'll throw him a few hundred thousand rather than have it tied up for years in court. And he's probably right.

Legally he's fucked. But that won't stop some greedy attorney from taking it on a contingency fee basis and raking 40% of the eventual settlement. Also, it is probably smarter for the gang to give him $2 or 3 hundred K to just go away and leave them alone. Not fair, but life today is seldom fair.
