California Bans Open Carry of UNLOADED Handguns

I don't understand the concept of carrying an unloaded weapon.

I have my CCW, I carry more often than not, but never carry open.

Either way, I would never carry unloaded. That's like having a shovel without a handle.

So, basically the criminals know that law abiding citizens aren't packing. I guess in order to make sure one is protected some people are going to become criminals.

Only law abiding idiot sheep without concealed carry permits would pack a gun concealed or unconcealed UNLOADED.

My dad open carries...or should i say used to. He tried to get his ccw twice and has been denied. They said he doesnt need it. A neighbor two blocks down was just stabbed trying to stop some taggers...its not a safe neighborhood. My dad is very pro 2nd amendment and will be veru unhappy.

I am quite torn by this decision, but overall, I am happy due to the fact that officers on the street have a HELL of a time determining the intent of the person they are contacting, who may be carrying openly.

The fact remains that the "gangbangers" never really caught on to this, which is what we feared in Law Enforcement. For the most part, 2nd amendment advocates were the ones pushing the issue and ending up on the six o'clock news. This caused peace officers like me (Yes, I expect all kinds of flames from the anti-police members here), to be cautious when dealing with armed subjects, but keep in mind that we mere most likely being tested.

The truth of the matter is, I support a citizen's RIGHTS to have a and bear arms. But I do NOT upport a loop-hole that allows felon who is unknown to me, or a person who is on their way to commit a crime against another, to walk down the street with impunity while our (Law Enforcement's) hands are tied.

The reality is, most "law abiding" citizens who illegally carry a concealed firearm will and DO probably get away with it. They quite often stay out of the attention of Law Enforcement, would never commit a crime or use the weapon except in self defense and therefore don't concern me much. (I assume that EVERYONE is armed, until I find otherwise... And that generally results from some criminal entanglement THEY have initiated.)

I believe unless you have a felony or a mental disabilty that it should be mandatory to graduate Highschool that you take a gun safety course and actually have to fire the gun at paper targets .

I think you forget, that the purpose of society is for the average member to enjoy those rights. The right to bear arms, the right to be free of unwarranted search an seizure the right for a person to be secure in themselves and their possessions are for all people, not just the ones with badges.

It is because of the gangbanger and the people who intend to commit crimes that the average member of society should be armed. Leaving that average member intentionally defenseless is criminal. And please, with the increasing number of rouge cops on the force that good cops turn a blind eye to, the need for an armed populace becomes even more prominent.

Dont worry this will end up benefiting gun owners. A judge not too recently denied a case about freely getting CCW permits because he said everyone had a right to carry unloaded weapon and therefor did not have a right to CCW.

Now that thats not an option the case will have a great chance in appeal / supreme.

"For a majority of Californians, this creates an absolute ban on the bear part of the right to keep and bear arms because they can't get a conceal carry permit," he said.

C.D. Michel, a civil rights attorney for the National Rifle Association, said the group has a lawsuit challenging the concealed carry licensing system in San Diego. He said the federal judge in the case ruled the system wasn't a violation of the Second Amendment because residents still had the option of unloaded open carry.

"This strengthens our lawsuit because that option has been eliminated," he said.
