When they come to repossess take them to court. You don't even need a lawyer. Just fill out the papers and show up in court and do it yourself. They are so busy they wont even show up. Boom you win. Eventually they will come for it but I will be in another country with all the money I saved.

Two years ago, my husband was very ill and lost his job. We got behind on our mortgage and they told us we could negotiate for a modification and they sent the paperwork. It was going to take awhile to complete it given what all we were dealing with, and I doubt we would have qualified with no income at that time. A month later, we got a letter from an attorney - the lender had turned it over for foreclosure without waiting for our paperwork and without notifying us.

We were panicked - we did not know all the laws and with the stress of what was going on as my husband was more ill, we could not afford to go into foreclosure and have to move. We borrowed some money for the bill that included almost $1,000 in attorney fees.

So I can't imagine that anyone would CHOOSE to deal with all that, to have that threat hanging over their heads. Many don't have a choice, but to just outright refuse to pay - at least in this state - I think a person would have a foreclosure on their record.

Yes they can , I just heard on the radio that in America it takes on average 826 days to finalise a foreclosure and often the banks will pay about $1500 to get the owners out.
