Fun runs are mostly used to raise money for charity. It wont surprise me if they put a run on to raise money for the victims of Sandy later on. Back at the start of this year in the blue mountains near Sydney theres a run called the six foot track its 45kms. This year the RFS canceled the run because there was heavy rain fall and a creek that runners had to cross was dangerous. Almost all 1000 runners were happy with their entry fee (over $100, cant remember the exact ammount)being donated to the fire service. If the OP is for real and not trolling he doesnt stand for the average runner. |

An act of god is one thing, mismanagement by the mayor and New York Road Runners is another. They had a chance to cancel the marathon after assessing the situation and said the marathon was on. Runners then came to NYC spending their own money on plane tickets and hotel rooms, just to be screwed by the mayor and NY road runners who bowed to pressure by "resilient New Yorkers." Did these "resilient New Yorkers" whine to close all businesses, or other sporting events such as the Giants game is respect for the victims of Sandy? |

The only thing he lost was the registration fee which he thinks they'll be donating, but they may decide to give the runners the option of refund or donation. He decided not to run after he saw the destruction and the suffering going on. He wasn't going even if the marathon was held because those from the state running club he is in that were going decided that it wouldn't be in good taste to run and use resources that could be used to help people. According to him any runners that were supposed to run will be guaranteed a spot in next years race. OP, There are probably 50 people waiting for every 1 person chosen to race so I seriously doubt New York will miss you next year. You obviously aren't one of the "elite" runners (don't feel bad, neither is my neighbor). Just be happy that you aren't one of the people displaced by the storm and pray that it never happens to you. BTW, Neighbor says the hotel was refunded because he canceled in time and airfare was refunded thanks to flight insurance. |

No lawyer who got past the first year of law school would take your case. Bloomberg or the city? You'd never get past their sovereign & qualified immunity. The NY Road Runners? Even assuming there was a completed offer & acceptance (i.e. – that a runner was already guaranteed a slot in the race & all they had to do was show up with ID), the agreement clearly states the event can be cancelled for a variety of reasons that apply here. You're bound by the terms of the contract. An additional defense is "frustration of purpose" – when supervening events seriously affect the value or usefulness of a benefit expected by the other party (the people you're suing). These supervening events don't need to make performance impossible or even more difficult. See, Chase Precast Corp. v. John J. Paonessa Co., Inc., 566 N.E.2d 603 (Mass. 1991) (denying a breach of contract claim when the state highway department cancelled the installation of median barriers because the purpose was frustrated due to an unanticipated public outcry over their appearance). And what would the remedy be? Reimbursing your travel expenses? Restitution for partial performance doesn't compensate you for expenses that were incurred in preparation for your performance or that didn't result in a benefit to the other party. See, Farash v. Sykes Datatronics, 59 N.Y.2d 500, 506 (N.Y. App. 1993) (the defendant must have received the plaintiff's performance; acts merely preparatory to performance will not justify an action for restitution). In other words, the money you paid for travel didn't go to Bloomberg, the NYRR or anyone else who had anything to do with cancelling the marathon. And for the same reasons, any claim of unjust enrichment will also fail. So good luck running into your legal brick walls. You're either a troll or an idiot. Maybe both. |
