Andre Barbosa is squatting in style.

The 23-year-old has moved into an empty $2.5 million mansion in a posh Boca Raton neighborhood, using an obscure Florida real estate law to stake his claim on the foreclosed waterside property.

The police can't move him. No one saw him breaking into the 5-bedroom house, so it's a civil matter. And the real owner, Bank of America, isn't responding to questions about the home

Where not repealed by Congress or executive order, all laws prior to 1776 still stand in the US which were passed by England - although the number is absolutely tiny.

The law of squatting is based upon the same law that allows salvage operators to rescue abandoned ships and why the last man aboard ship is, traditionally, the Captain who either goes down with the ship or leaves ONLY when there is no hope of saving the ship.

In about 1100AD, only about one in twenty kids actually reached their 30's without dying. With so much kit abandoned or lost by so many people who had died without any family left alive, the Magna Carta had a law to allow for "recycling" of goods that we abandoned.

If something had been abandoned for a long period, you could claim it. For real estate though, as this was precious, the time period was very, high - 20 years and ONE DAY.

In the case of other possessions, the time lag is less.

TO claim the real estate, one has to enter the premises WITHOUT breaking any windows or locks and then prove the date of arrival - usually by registering on the electoral register in the UK. once established, a "rigthful owner" has 20 years to throw them out or invoice for rent - even if just one pound sterling. For this reason, it is of great benfit for the Bank of America to do and say nothing at the moment as they have 20 years to get him out BUT his presence actss like a free security as no vandal can break in and burn it down while he is there.

It is rare that it will run for the full 20 years before anyone knows about it, but a case in the 1990's forced the British Government to repeal it. A couple got into a huge mansion house in Central London worth about $20million which had been left idle by a property company. They registered on the Electoral Register and took photos proving that they were there, but DID NOT connect gas, electricity or anything else,and only flushed the toilet once a day at about 3am. They lived in two rooms right in the back, centre of the house so they would not be noticed, and shopped for tinned food, sneaking out to late night shops to stock up.

No-one knew they were there until, in the late 1990's the property company were notified that a $20million mansion house of theirs was in the process of being transferred to people that they had never heard of. Their appeal was chucked by the courts and the people who had camped out made a cool $20million for 20 years of theiir life, camping out and livnig on Tuna.

IN another case, after the Second World War, a cold and frozen man climbed into a house in Notting Hill in the late 1940's. He intended to apologise when the real owner came home so he looked after the palce very carefully. When the owner didn't come home for a few weeks, and the electricity was turned off, he had it reconnected under his own name. He noticed a number of pictures around the place of a fighter pilot with the RAF who he presumed to be the owner.

In 1968, he formerly claimed the house as his. It turned out that the pilot had been "missing in action" and had no relatives. As he had no relatives to declare him "dead", he had stayed "missing in action". The value of the house in 168 had risen to about 100,000 sterling.

In another incident, a man knew of a rich Kuwaiti family who lived up the street. A wekk or so after the entire family went back ofr a visit to Kuwait, Saddam Hussein invaded. Outside was a brand new Rolls Royce.

After the end of the war, although there were several parking tickets on the ROlls, no-one had returned to the house, so, after waiting 18 months, the guy had a towing company tow the Rolls WITHOUT opening any window or door, onto his own driveway. He then posted advertisements in the newspapers for a few weeks. A few days later, he had a lawyer serve official notice on the Driver and Vehicle Licensing Centre at Swansea in Wales that he was formerly laying claim to the Rolls. A few days later, he received full and correct title to a machine worth well over a quarter of a million dollars.

I feel bitterly angry that the Gatineau Police in Quebec ignore the laws (sections 921 to 941 of the Civil Code inclusive) According to that, an unclaimed item can be claimed after 61 days. I found a nice Iphone in the street and handed it in. It was easy to contact the owner, but, to my surprise, the owner turned out to be some spoilt rich brat with more money than sense who told the Police "Oh no, that's yesterday's model and besides I've got a new one now. I really can't be bothered to collect it". Despite this, the Police refused to hand it over to me after the 61 days and just gave it to one of the Police officers at the station. Worth $200 or so, it was, sadly, not worth hiring a lawyer to sue the Police over it.

Nank of America would have to be clinically stupid to do this. If the person knows about sqautting, then he knows the law and will have taken the normanl and obvious steps.

Once inside, the squatter will normally made sure that they are photographed with the latest copy of TIME magazine in hand in front of each of the windows and door to prove that they not broken.

Remember, to Bank of America, so long as they can avoid comment, it is MASSIVELY to their benefit to leave him in place. once they comment, however, they HAVE to take action to remove him otherwise then and there they are effectively giving up ownership.
