They EO can't be enforced, but the agencies created by the EO can create regulations that can be enforced. In the end, SCOTUS can decide whether a regulation is constitutional or not, but that is contingent on which way they are leaning. They can't at any time say whether or not the agencies created have a constitutional right to exist or not.
