IT IS CHEAPER TO PAY THE 3.5 FEE AND HERE IS AN EXAMPLE:

Just this week a Maryland panel recommended to that state’s governor and legislature new taxes and fees to fund its state exchange.[2] The Maryland report projects annual administrative costs for the state’s exchange of $201 per enrollee in 2015, declining to $152 per enrollee in 2017.

In contrast, applying the 3.5 percent fee set by HHS to the $2,770 national average per-capita premium for all commercial group and individual major medical insurance sold in 2011 yields a projected annual administrative cost for exchanges of $97 per enrollee. The much higher Maryland figures are significant as they reflect thorough and detailed work by the state most committed to implementing a state Obamacare exchange.[3]

Well, for one thing, Arizona became the 17th state to opt out in November of 2012, but has since agreed to set up an exchange so they don't even belong on your list.

The number of states opting out as of September 2013 is 26.

It would actually be easier to put a list of those states who are participating:

Arizona.
California.
Connecticut.
District of Columbia.
Hawaii.
Illinois.
Maryland.
Massachusetts.
Minnesota.
New York.
Vermont.
Washington.

Hopefully this quoted properly to the AC OP. Yes, those bills did indeed become law, both State and Federal. As have many other mandatory health and safety laws such as inoculations, etc.

Where I have great concern is with the lack of planning by the Feds for oversight and auditing. This program will be a free-for-all for fraud, waste, and abuse exactly as Medicare and Medicaid are currently.

By all rights, rather than implement a new program, the Feds had an existing plan, Medicaid, that if expanded to include low income insurees would have been a viable and acceptable alternative. With proper oversight and auditing of course.

This is where I am stumped, OP. The need for a new medical insurance program was and is not there. What are the Federalists hoping to achieve?
