I just called the DAs office again after posting this. I'm gonna try to out some more pressure on them. See if I can get a full report on their findings and take it to the state level. Marie34 |

Heartbreaking story of injustice. I posted about this awhile back not long after it happened and a lot of people assured me he would be charged but still hasn't been. She was shot in the temple by him at point blank range on November 3rd 2012. Quoting: Marie34 He claimed she was handing him the gun by the barrel and shot herself in the head. They said they were able to rule out her shooting herself 100%. All of our family was convinced he would go to prison. It was the most blatant case of murder I've ever seen. He is an alcoholic and drug addict who is on disability for DEPRESSION. She worked and supported him and their kids for over 30 years. He beat her, isolated her, controlled her. Threatened to kill her and their kids many times. I know she played her part in staying with him, but she had a very low iq and low self esteem. He preyed on her and took everything from her. They were poor, she delivered pizza to make money for him. The Detective told us he wanted to see him in prison, but the DA WILL NOT prosecute bc he says there isn't enough evidence! Ruled it a suspicious homicide and said maybe something will come up...I don't get it. I've had nightmares since this happened, I'm so frustrated and heartbroken over this. How does this happen? I never knew how unjust and corrupt our system really is until this. It still shocks me and everyone who knows about it. Is it bc she was poor and of low status? Some facts- after he shot her he washed his hands before the ambulance got there, she lived for several hours in the hospital before she passed. He first told his son they were fighting and she shot herself who told us all this at the hospital, then changed his story. He never served one minute in jail and was only questioned twice. He has never spoken to our family since. He showed up at the funeral we paid for and organized, sat in the front and dramatically made a scene. Then refuses to pay for anything, demands we buy a double headstone with HIS name on half and purchase the plot beside her for him since he can't afford it on how govt check. We get this communication from his grown kids who all enable him. How do I not let this eat me up inside? Is there any way to go around the DA? I'm just sick over it and so is my family. and yet there are men who want us to go back to living that sort of life. tells you a lot right her doesn't it? |

Either of these options though, you better be squeaky clean because you'll be starting a war. You might find out who's running in opposition against the current DA, and drop him the story. I said but you told us that you aren't pressing charges and it has been almost two years we have a right to the facts. She said well I'll see what we can do. I said what? We have been patient and waited and we have a right to this, I said we've talked to a private investigator and we are not letting this go...she said she needed to talk to the DA and would call back... Called right back and gave me the case number and told me how they had worked SOOOOO hard on the case, I told them this was absurd and ludicrous! She said I would have to file a request for the case files citing the georgia open records act. Said there's just not enough evidence RIGHT NOW but it's open..blah blah. Marie34 |

The biggest piece of evidence to me is this he claims she was HOLDING THE GUN BY THE BARREL when it shot her in the temple (this means she was handing off a loaded gun LOOKING AWAY BY THE BARREL, right!) and there were NO burn marks on her hand. None, she was not holding that gun. We had to bring that up ourselves! And they were just like, yeah that's true...wtf??? Marie34 |

Well the DA himself said it was his decision, so did the detectives we talked to. The investigator from his office just said that it's open but they don't have enough evidence. The officers told us they know he killed her intentionally and were frustrated like we were. 2 weeks before he killed her he called one of her sisters drunk and said he would pay her if she would tell him what my aunt had been up to and who she was seeing...which was crazy. She did nothing, but he was sooo paranoid and controlling. Marie34 |

Killers have admitted killing people and are never prosecuted. Something not of this world handles the situation and the situation goes exactly how that something directs it. How is it you see the truth and the agencies dishing criminal law will not. He knows better than to kill my sister cause I will fix him real good. Is scary. Bc apparently the easiest way for a man to kill a woman is blatantly and say it was an accident. Or a woman to kill a man too I guess. I know it's bigger than the external issues at play, I deeply believe that the universe and God is just. That is what I cling too. Sometimes it overwhelms me though, and it did today. The dreams just bring it back. I just want to do something for her. It was an open casket, and her face looked like she was crying. She was one of those people that were just completely passive, always smiling and nice, seemingly oblivious to negative things. Maybe that was how she dealt with the abuse or adapted? I don't know, it's just sad and tragic. In her billfold she had my number written on a piece of paper tucked away. He didn't allow her to talk to me so it had to be secretive when she did. I wish I could've saved her. Marie34 |

In a civil case, the plaintiff has the burden of proving the facts and claims asserted in the complaint. If the respondent, or defendant, files a counterclaim, the respondent will have the burden of proving that claim. [link to legal-dictionary.thefreedictionary.com] |
