Trespassing requires that either (1) the land was posted with no trespassing signs, or (2) you're first told to leave, then you either stay or come back later. Neither appears to apply here. He told him to get lost at the beginning of the video. The guy then tried to follow him in his business. Get lost means get lost. It doesn't mean follow me across the parking lot and into my business. |

THIS GUY AND HIS SON ARE SCUMBAGS. The old guy is the father of a convicted auto dealer who opened a new shop in Gainesville, even though he doesn't have a license. Richard Wilder, 43, owner of the now-defunct Braselton Used Auto Sales, was charged with seven counts of theft by deception and one count of racketeering for purportedly depositing customers' tax refund checks into his own account. He was ripping off people every chance he got. In addition, CBS Atlanta said that Wilder had been previously indicted for odometer fraud, forgery, computer theft and other charges in 2009 and 2010, while also pleading to two felony charges in 2011. Following the September incident, the Georgia secretary of state issued a cease and desist order against Wilder for operating a used auto dealership without a license. However, far from being discouraged, Wilder and his family simply moved their shady business to Gainesville! Chirico discovered the Wilder family's new shop named "EZ Auto Sales" at 1608 Atlanta Rd. in Gainesville, and tried to interview the 43-year old after learning that he is not licensed to sell used cars in Georgia. |

Quoting: Hijinnx You don't call being grabbed by the shirt by a guy with a clenched fist a warning? He didn't punch him the first time. I'd call that a warning. He could file charges just for being threatened. Grabbing a man by the collar is assault. Well the important part is that he didn't call the cops the first time. He threatened to, but continued to harass the old man. The reporter was just asking questions on public property (not private: a place of business). Completely covered by the First Amendment. Getting grabbed by the collar and later punched in the face, completely illegal and a felony. Places of business are private property. Though they are open publicly, during hours of operation, to customers. In order for the press or media to gather news while on private property, they must first obtain explicit consent from either law enforcement or the property owner. I see two different situations in this video. First, the reporter is on public property, as it seems. What happened there, his collar being grabbed, was enough to have the police called for his defense and protection. He made a threat to call the police, the store owner agreed to have them called.. The police were not called. They were used as a threat for compliance for a man to act against his own best interest. Then the reporter followed the owner onto private property, which may be considered public only to those who are welcome during hours in which the store is Open for business. The man had just unlocked the door, the store was not yet open. Then the reporter placed his hand on said property, opening the door in order to enter without consent. Do you see why this would look bad in court for the reporter? If someone attacked or threatened to attack you, you do not follow them or attempt to follow them onto private property. The press must first get explicit permission or "licence" to be on private property. I would assume the reporter did not do that judging by the owners reaction, but that is something we do not know as viewers. |

His intention was to continue to follow him. The owner was there to object to their presence, and they didn't leave. The reporter was antagonizing the owner at that point. When there is verbal instruction for someone to leave, a No Trespassing sign is not needed. Just as verbal consent is all the press needs to obtain "licence" to be on someone's property. |
