My 16 year old daughter was broadsided by a crack-head who swore at her and threatened her... advice?
So, my 16- year- old daughter was with a friend at a 4 way stop. She was driving. It was her turn to go through the stop and she proceeded through. She was in a Pontiac Sunfire.

As she was halfway though a big F150 truck accelerated and hit her car - bending the front end and smashing the door into her.

He backed out of the accident, and, began to flee. My daughter followed him. He stopped at the next turn and got out of the car. He came started hitting the top of her car (she couldn't get out- the door was smashed) and calling her a stupid c=#* and screaming "no police, b#tch". She was crying and shaking and now her car wouldn't start. He asked her how old she was, and, she yelled, "16", At which point he said, "don't call the police. I don't want you to get into trouble"

People in a nearby house came out, he wrote his name on a piece of paper (which he didn't know had his insurance agent on it) and fled the scene.

The people in the house helped her crawl out of the passenger side and call me. Her arm was badly bruised and had the imprint of the door handle on it.

When we look up this man's public records, he has had his license suspended 5 times for driving under the influence. 3 of the times specifically list cocaine.

I am now dealing with insurance and looking for advice...

she was injured? so leaving the scene of an accident is a felony in most states I believe. Report them....


I googled this...

Misdemeanor Hit-and-Run

In most states, it's a misdemeanor hit-and-run if one leaves the scene of an accident that only results in property damage -- in other words, if no one was injured in the accident. A misdemeanor is usually coupled with large fines of about $1,000, and possible jail time of up to a year.

Felony Hit-and-Run

If the accident involves injuries to others -- whether it be the other driver, a passenger, or a pedestrian -- the punishment can be far more severe. This would be considered a felony hit-and-run. Felony hit-and-run penalties vary by state, but they will likely involve incarceration and/or a fine of up to $10,000.

It is a felony in all states if one leaves the scene of an accident that results in the death of a person.

Keep in mind, both these misdemeanor and felony hit-and-run charges are as severe as they are because of the "hit-and-run" (fleeing) aspect.

File a police report. You have witnesses. File restraining order if things get ugly...and gently remind him you are a VERY protective dad and will gladly go to jail to defend her as you see fit if he thinks he wants to get any stupid ideas.

It is actually Wisconsin- Southern Wisconsin.

I really wish the friend would have recorded it, too. They were both just so scared they froze.

The car is totaled- it pushed the wheel in far enough that a round disc (I think it is a shock or strut) is pushed down into the tire. I am thankful that the impact was to the front and not her/ her door.

I have talked to his insurance- he won't return the calls that they are making to him, so, we are going off of the police report. We did call the police once I got there.

They think that she has bruised nerves in her arm- since she has strange pain and numbing. Thankfully there is no broken arm.

I would beat him up, but, I am her 5'4" mother. I DID however tell the officer that I wanted to just smack him a few times. LOL.

I am nervous about how to proceed with the insurance. I don't want to make any important mistakes. His insurance is calling him the 'at-fault party'. So, that is good, I think.

I'm at home and in Dallas so I'm not sure how auto coverage may be written ins Wis but I can tell you, in Texas sometimes insureds will not cooperate with the insurance company. I can check Wis auto policies from my office tomorrow if you need me to.

When this happens it's difficult for the insurance company to resolve the claim because regardless his behavior they will not pay a claim unless they know the insured was responsible for causing the accident.

Have you consulted your own insurance company? Most auto policies include coverage for medical injuries to occupants in your auto, even if the accident was not at fault. This would be under the heading of "medical payments" or "personal injury" coverage. You will need to consult your agent or policy to determine if your policy has this type coverage to help pay the medical expenses for your daughters injuries.

Did you have collision insurance on your car? If so, your insurance company can take care of the damage, subject to your deductible and then do what's call "subrogate" against the other company to try to recover both your and their money.

Again, if you need anything just ask...I'm more than happy to help.

btw...I hope your daughter will be ok.

May be check the year book for his last name, Then inquire if any situations arose in school with possible relatives.
One thing that stands out is it sounds like a four way stop and the damage and location sounds sketchy.

Thank you. His insurance company has said that they would go off of the police report. The police officer went to his house the next day and gave him 2 tickets- 1 for inattentive driving and 1 for not carrying enough insurance.
He is also labeled as the only one that had contributing factors to the cause of the accident.

It was my neighbor's car who has insurance, but, not collision coverage.

My daughter has given statements to both insurance companies, and, his insurance company seems very nice and like they want this to go away (possibly so that they can drop him?). Is there any reason I should be hesitant about speaking with his insurance company? He has Progressive. I have yet to meet Flo, damn it. LOL

The OP is describing a crime.

Police do not stipulate about who reports a crime but if there is evidence that a crime happened. A smashed car, the name of the person, and a witness to the man leaving in a hurry are enough evidence to secure an investigation.

That is a scary thought. I can't imagine there would be. It is a fairly small-ish town (70k), and, we aren't from here originally. Also, myth daughter is really very agreeable, pleasant, and upbeat. I don't think she has any enemies (at least that we know of).

Now I am going to be creeped out by that. LOL. I will have her look at yearbooks tomorrow and see, though. You never know, I guess.

1. Fall on your knees and thank GOD your daughter is OKAY and ALIVE and will live to drive and walk and enjoy life, again. Many people in the same kind of accident were not so fortunate.

2. Make sure that witnesses and the police know everything you and your daughter know.

3. If you want to push it, and the cops won’t go out of their way to investigate, hire an accident investigator of your own (about $500 for a few days work) and let him/her see what they can develop. One man we know did this for his kid who was charged with causing an accident - and they found video of the entire scene including at the time of the accident. It happened like the boy said it happened and not as the police supposed. The boy was not at fault and the other driver was and was charged with reckless driving and worse.

4. you can always hire a private detective to find this guy and see if he wants to “settle” or go to jail. He left the scene of an accident. Big criminal charges here. And you have witnesses. He has insurance. Call your insurance company and send the bills all to them - but make sure they go after the other guy for repayment of everything you have paid out on your behalf (your daughters behalf) and let their lawyers settle it.

Some friends kid was hit by a drunk driver who left the scene. Witnesses, cell phone cams, etc. The parents had their lawyer call the driver who hit their kid’s car and they got a one-time payment of $250,000 plus medical expenses in exchange for dropping the entire thing. This was not an insurance payment. It was a wealthy woman buying her way out of serious trouble Just make sure it’s expensive if you go that route.
