What I get from seeing that video is the fact that 9mm just doesn't cut it! Looks like he was shot several times before going down, and it didn't slow him or push his body forward or anything.

I believe you may be underestimating those who use stories like this to ratchet up the tension. They won't care if he was arrested, they'll focus on the crime itself. Whatever will create the most anger, will be the angle taken.
