Do I need to report the state or local refund I got last year? Is it taxable? You should report last year's state or local tax refund. We'll figure out if it's taxable or not. If you took the state and local tax deduction last year and itemized, the refund will be taxable this year if the deduction benefitted (reduced) last year's tax bill. This is true even if you opted to apply the refund to this year's state or local return. But if you took the sales tax deduction or the standard deduction last year, it won't be taxable on this year's return. It also won't be taxable if last year's return was subject to the AMT (Alternative Minimum Tax) and the refund amount was less than the amount disallowed under AMT. After you enter last year's state or local refund in TurboTax, we'll ask followup questions to determine if it's taxable. Tip: When you transfer last year's return over, we'll also bring over last year's state and local refunds if last year's tax file includes those returns. A refund from the IRS is not considered income and is not taxed; however, your state income tax refund is another matter. Let’s assume you overpaid your taxes to Ohio on your 2004 return and got your refund in 2005. You probably deducted the full amount of those state taxes on your 2004 federal tax return. But because you got that refund, you actually overstated your state income tax deduction on your federal return. The result: you paid less federal tax last year than you actually owed. You have to claim it as part of income. Very odd. Already paid taxes on that when you took it out of my check. They collect interest on it then I get it back and REPAY taxes on what was my OVERAGE of payment of tax. Don't get it. Been complaining for years. |
