They did not violate the law under the Fair Debt Collection Practices Act. I have used the FDCPA in every other related case -- and won on all of those -- but could not use it here based on other rulings. They are using automated dialers to harass people that they think owe a debt. Calling at times when it is legal. They had no 'do not contact by phone' order. They were not saying anything that violated the Act -- most of the time they were not saying anything at all. The rare occasion that they were on the other end of the line, they broke no laws - directly. So I went after them under the Telephone Consumer Protection Act because I was on the Federal Do Not Call list. They tried to get exempted from that law by going to the FCC - and failed. It was already against the law. So why in the would I spend the massive amount of time and effort to try to get legislation passed? Even in my case, when I tried for more than TWO YEARS to get them to stop. I could have handled this case myself... and maybe settled for a few thousand dollars. Maybe. More likely the company would have fought me personally just as they did the class action lawyer... and I would not have had the resources to fight them so they would have won. This way they lose... the company who is harassing people and violating their rights... violating the law. They lose. If the lawyer makes a lot of money --- so what? This is a capitalist system.
