2010 Census AND American Community Survey!? Do We HAVE to Answer the Latter?
What is the difference between the 2010 Census and the American Community Survey...and do I, by law, have to answer both?

According to the laws I could find under Title 13, I only have to answer the Census. Does anyone know?

Here is a link to the proposed 2010 Census Questions which are no big deal. but the American Community Survey is a terrible breach of privacy.

Apparently the American Community Survey is not being asked in 2010.

and the Administrative Questions they ask in the Census are not mandated by law and you don't have to answer them.

I got the American Community Survey. Apparently they send it to random households each month of every year in preparation for the 2010 census instead of random houses getting a long form census and most getting the short form. ( [link to 2010.census.gov]

I think it is VERY intrusive, asking me questions about my electricity bill and such. I am still struggling with what to do.

So far, research has turned up that they can fine you for not completing a census form, something like $100-$500 dollars. However, it doesn't look like it has actually been enforced in more than a few cases. Again, I'm still trying to decide what to do.

Meanwhile, I continue to get phone calls from the Census Bureau and some 520 area code asking me about completing the form. As my husband puts it, we are certainly not giving out that info to someone who calls us on the phone.

Thank goodness for Caller ID while we figure this one out.

I wonder if the ACLU has thought about taking on something like this?

Any other thoughts on how to handle this? wtf

It's not true that it's $5,000 and $100 per question. I looked up Title 13 and it says for failing to ANSWER THE QUESTIONS ASKED, you can be fined $100 and no more. No one minds giving no. of people in house, age and sex - that's how they choose the number of our reps and any schools necessary in a given area. I haven't ans'd a census in 20 years and don't plan to ans this one. It's an invasion of privacy. That's not entirely true... fined "maybe" (and by their own admission they claim they don't really enforce it) but not jailed... research shows that the last people actually prosecuted for this were in 1973. I don't mind abiding by the constitution (which asks for a headcount only), so in 2000 I simply filled out the first question, asking how many people lived in my home, and I mailed it back. During the 2000 census only 67% of the people responded and no one was prosecuted for not responding. BUT they may come to your door, leave you notes and call you numerous times before they finally give up! I'll respond the same way this time by giving them the number of people in my home and that's it! They can collect the $100 fine from me "if" they decide to do that but at least I'll have the comfort of knowing that my personal information is not on their computer systems waiting to be stolen and/or abused by someone! BTW I received the 2010 census today 3/19/2010... it's asking how many are living in my household as of 4/1/2010... since that's not here yet can I just put "0" and mail it tomorrow 3/20/2010??? peace

I received the American Community Survey last year or the year before. It does indeed say that they can fine you up to 5000.00. I tossed it in the trash. They called, I said I had never received it. They sent another. Again, file 13. They called several more times then gave up. Haven't received anything this year. They did send a postcard saying they were going to send it, but have not done so. We shall see.

Why do they even need this census? The town I live in changed the population #'s on the signs a WEEK ago. They're either getting the OLD numbers ten years late or the NEW ones too early. WTF?

I too got the ACS long form. It's very intrusive and most of the questions have nothing to do with counting heads. We are assured, by the same government that can't keep defense secrets, that our information will not be released to anyone. However, the Census Bureau hires seasonal, bottom of the barrel employees. What's to stop them from stealing the information and selling it to ID thieves? The Post Office also hires bottom of the barrel employees. What's to stop them from stealing a sack full of ACS forms and selling the information to ID thieves. The U.S. government is quickly becoming the government of the old U.S.S.R. hiding

STOP the American Community Survey or ACS Now!

Only a very naive person would fill out the American Community Survey or the ACS with all the risk associated with the need to protect personal security. History shows, between 1942 and 1947, the data that was collected by the census bureau was handed over to the FBI and other organizations, at the request of President Roosevelt, and that’s how the Japanese were rounded up and put into the internment camps.

There is a bill called H.R. 3131 that has been presented in Congress but not passed yet. You need to contact your Congress representatives and senators and demand that they pass this bill immediately. For the fellow who thinks we should just tell them how many flush toilets we have.........was it you urging the jews to register in pre WW2 in germany, I mean what is the worst that can happen right? Not in this country you say....all the native Americans and Japanese Americans how this works with our census bureau, you will be thrown under the bus without a second thought i assure you. Information is power, in this case that power to be used against you.In my own case I am a 60 yr old man whom my government has decided to terrorize with threats of spending 5 years in prison or taking my life savings.......now tell me how sick and out of touch with reality are the people who came up with this

ahhh such a delightful wit and brilliant also i see with all the social skills of oversexed dog. The fine can actually total up to 25,000.......but pray tell you think $5,000 and acceptable fine for refusing to answer questions about ones personal life which your own children do not know? Quite frankly the federal government has long ago far overstepped its constituitonal mandates and taken on the mantle of big brother. But being such a big history buff I am sure you are familiar with all this, perhaps you even read.......perhaps 1984?

If the Democrat's DNC would get on board as the RNC had recently done then bill H.R. 3131 may have a good chance of getting passed into law.

Robert Groves, director of Census pretty much confirmed no one would be fined for non compliance in the ACS.

If you refuse to participate in the survey, keep a copy of Mr. Groves comments to use in your defense should the Census refer you over to the Justice Department to impose fines upon you for refusing to participate in their UNAMERICAN survey. From all I've read so far, no one has been fined or jailed for refusing to participate in the American Community Survey.

Educate yourself on the role of the Census and what the Constitution requires you to do when responding to the Decennial Census (sent out as a short form every 10 years) and the dangerous, intrusive American Community Survey or the ACS (sent out as a long form to 250,000 American households every month and each and every year (3 million/year). If you haven't received the ACS yet, you will...It's just a matter of time!

it's ridiculous to believe your civil liberties are being invaded. if you like having crowded schools, no public transportation, poor road conditions, etc., then, by all means, ignore the survey. it's the uneducated and ignorant who believe this survey invades our civil rights. educate yourselves, people...www.census.gov
