Page 2 Return back to page one click HERE If a Police Officer Stops You On The Sidewalk... You are perfectly within your rights to say to the officer who asks to speak with you, "Officer I do not want speak with you, good-bye." At this point you should be free to leave the officer's presence. The officer may not like this and may challenge you with words like, "If you have nothing to hide, why won't you speak to me?" Just like the first question, you do not have to answer this question either. There is NO law that says you must tell a police officer where you are going or where you have been. So keep your mouth shut and say nothing! The next step the police officer might take is to ask for identification. If you have identification on you, tell the officer where it is and ask permission to reach for it. Probable Cause... A police officer has no right to detain you unless there exists reasonable suspicion that you committed a crime or traffic violation. However a police officer is always allowed to initiate a voluntary conversation with you. Sometimes it is unclear whether or not a person is detained. If you are in doubt, you should ask the police officer if you are in "Am I Free to Leave." Now if the police officer doesn't have "probable cause", and you refuse him to search your car, he might bring in a drug dog. At this point since the officer has no probable cause, he may be illegally detaining you. Tell the officer that you have an appointment and you're running late, and you really don't have time to stay. Ask him if you're "Free to Leave" so that you're not late for that appointment. Under the Fourth Amendment to the U.S. Constitution, police may engage in "reasonable" searches and seizures. To prove that a search is "reasonable," the police must generally show that it is more likely than not that a crime has occurred, and that if a search is conducted it is probable that they will find either stolen goods or evidence of the crime. This is called "probable cause." Police may use first hand information, or tips from an "informant" to justify the need to search your property. If an informant's information is used, the police must prove that the information is reliable under the circumstances. Here is a case where the police used an "informant's" word and the police officers took it upon themselves to kick in a door of a home at 1:30 in the morning without obtaining a search warrant. The aftermath was six police officers firing over 30 shots and shooting an innocent man 9 times in the back as he laid on the ground. Read Story What You Don't Know Could Change Your Life Forever... You might be wondering, don't police tell me that I have the right not to be searched? After all when a suspect is arrested, he is told before interrogation takes place that he has the right to remain silent. The Supreme Court has said NO. According to the Court, the fact that a person might not know he has the right to refuse a search is merely one factor in the determination of whether his consent is voluntary. The Court has reasoned that the police do not need to give warnings -- to eliminate any doubt about the suspect's knowledge of her rights -- because warnings might detract from the informality of an otherwise "friendly" interaction between "civilians and the police." So you might ask yourself, is someone that would use something against you really a "friend?" The Supreme Court has explained that "the community has a real interest in encouraging consent, for the resulting search may yield necessary evidence for the solution and prosecution of crime...." Furthermore, the Court has concluded, it would be "thoroughly impractical" to require an effective warning about the right to refuse. Can We Trust the Cops? Are police officers allowed to lie to you? Yes the Supreme Court has ruled that a police officer can lie to a citizen while questioning them. Police officers are very good at lying, twisting words and they are trained to be manipulative. Police officers and other law enforcement agents are very skilled at getting information from people. So don't try to out smart the cop or try being a smooth talker because you will loose! If you can keep your mouth shut, you might just come out ahead more then you expected. The federal government made a law that says citizens can't lie to federal agents. They can lie to us, but we can't lie to them. Makes perfect since don't it? The best thing you can do is ask for a lawyer and keep your mouth shut. How can you be charged with something if you haven’t said anything? Although police officers may seem nice and pretend to be on your side, they are likely to be intent on learning about the habits, opinions, and affiliations of people not suspected of wrongdoing, with the end goal of stopping political activity with which the government disagrees. Don't try to answer the police officers questions, or try to "educate them" about your cause, it can be very dangerous! You can never tell how a seemingly harmless bit of information that you give the police officer might be used and misconstrued to hurt you or someone else. And keep in mind that lying to a federal agent is a crime. Officers may promise shorter sentences and other deals for statements or confessions. The police cannot legally make deals with people they arrest. The only person who can make a deal that can be enforced is the prosecutor, and he should not talk with you without a lawyer present who represents you. Teach your children that the cops are not always their friends, and the police officer must contact a parent for permission to ask your child any questions. Remember that the police are trained to put you at ease and to get you to trust them. Their job is to find, arrest and help convict a suspect. And that suspect is you! Lies That The Police Use To Get You To Talk... There are many ways the police will try to trick you into talking. Its always safest just to say the Magic Words: I'm going to remain silent and I want a lawyer. The following are common lie's the police use when they’re trying to get you to talk: * "You will have to stay here and answer my questions" or "You're not leaving until I find out what I want." * "I have evidence on you. Tell me what I want to know or else." (They can fabricate ''fake'' evidence to convince you to tell them what they want to know.) * "You’re not a suspect. Were simply investigating here. Just help us understand what happened and then you can go." * "If you don’t answer my questions, I won’t have any choice but to take you to jail." * "If you don’t answer these questions, you’ll be charged with resisting arrest." If The Police Arrest You... If you are arrested, the police can search you and the area close by. If you are in a building, "close by" usually means just the room you are in. If during a search or an arrest the police take anything from you, they must give you a receipt for every item seized, including your wallet and its contents, clothes, and any packages you were carrying when arrested. "I DON'T WANT TO TALK UNTIL MY LAWYER IS PRESENT" * Even if your rights weren't read, refuse to talk until your lawyer/public defender arrives. * If your arrested and can not afford an attorney, you have the right to a public defender. If you get a public defender always make it clear that the public defender is not representing you, but merely is serving as your counsel. * Do not talk to the inmates in jail about your case. * Within a reasonable time after your arrest, or booking, you have the right to make a local phone call: to a lawyer, bail bondsman, a relative or any other person. The police may not listen to the call to the lawyer. * If you're on probation or parole, tell your P.O. you've been arrested, but nothing else. * You may be released with or without bail following the booking. If not, you have the right to go into court and see a judge the next court day after your arrest. Demand this RIGHT! When you appear before the judge, ask for an attorney. An attorney has a better chance at convincing a judge to let you out on a lower bail then you could. |

What an assumption! Where exactly does it state anywhere that we give up constitutional rights by talking to cops without an attorney? And actually, if you knew statute rules at all, you would know that having an attorney speak for you is equivalent to telling the court that you are incapable of speaking for yourself, giving them instant jurisdiction over you by default of your admitted incompetence. Furthermore, if a cop is asking you questions and you fail to respond when there is no risk to you in doing so, they can charge you with obstruction of justice. Why not talk with them, if you say the right things at the right time, they really are good people even if working under corrupt directives some of the time. |

Freaking answer questions and cooperate! I have gotten out of 5 traffic stops by cooperating and just answering questions truthfully and with respect. Heck - I completely rear ended a Car merging onto a highway in view of a cop..... Chick in front of me decided to stop on merge I was on pedal to merge. CRASH On interview I told cop I'm dead wrong but dang - why did she stop? He chuckled - she was driving a boat car and no damage and he let me off with a verbal warning! Don't be a dick to authorities - unless you have something to hide - JMO Now if you are DWI, carrying pot or coke or a pipe bomb or unregistered gun please proceed as above advises - lol |

Pulled over age 17 doing an illegal left turn, First question was do you know why I pulled you over? Answer - yeagh I banged an illegal left officer. That startles them - honesty. Soon he saw I went to same school as his son and he sends me off scott free. Freaking 5 degree day with a tire blowout - As I'm changing tire cop pulls over and he chit chats and hangs out as I finish the change. As I get in car to leave - he flashes the lights..... Oh crap - I grab my license and go for registration in glovebox...... Well my dumbass wife had taken my license renewal that needed to be paid and maile out and put it in my car. By the time cop got to my window I knew my car was "unregistered". I immediately showed him the reg with stub attached that needed to be processed and said my dumb ass wife just put my renewal in my car. He laughed and said dude you are having a bad day, I should impond your car but just take care of this - ok? He let me drive away. This all said there are some rogue bad cops but if you done nothing wrong you are at no risk mostly. Your best bet to go silent on a cop is a very busy highway with minimal breakdown where they know the danger to all and want to get out of that ASAP. I saw a cop let a drunk driver in a car I was in go and said - get out of here and fast. I had one dick cop pull me over in unmarked car on a passing on right charge - Dude followed me for 8 miles before pulling me over. He was gung ho and abrasive and I just smiled and gave him what he wanted for ID etc and yes sir no sir - took my ticket and left |

Sovereigns know to use the command DON'T TOUCH ME. You will have to guage the reaction to this, well, before you order it. The pigs will assault you if they think they can cow you enough not to bring charges. You may also understand that the one who asks the questions, is the dominant one. Sovereigns have the option to ask questions in response to questions. You will have to guage when to use this to keep the violent reaction to a minimum. Or you can use it to provoke a violent reaction and sue later for assault with intent to do bodily harm, or attempted murder. If the cop asks you who you are, you ask, "What is your badge number and Identification? For all I know you may be a criminal thug dressed up in some official looking uniform, with a tin badge" (And you are right, that's all he is). Be offensive with questions rather than defensive. Be legal rather than violent. It works but they will do all they can to circumvent the law. Why? Because they are criminals, of course. Ethics and morals have no place in law. It's true. These are unethical and immoral people. The very worst of the human race. Understand that, legally, you cannot be touched, moved, transported or imprisoned. These are all criminal offenses if they do so. The crimes are criminal trespass, assault, assault and battery, assault with a deadly weapon, kidnapping and false imprisonment. Cops are code enforcers not Police. You can charge them with Impersonating a police officer. When you go to court the fraudulent judge (administrator) will attempt to dismiss all your charges so he can let the pig get away. Sue the administrator for his crimes, also. Complicity to commit a crime sound good. Sue everyone else who witholds evidence from you, stops you from collecting it or impedes your legal progress. |

Why would you want to give it to a complete stranger? With all the identity theft going on now-a-days, it could be considered quite foolish to give this info freely to a complete stranger. Your date of birth, btw, is nothing more than hearsay. I can honestly say, I do not know when I was born. I simply cannot remember!! In case you didn't know, any citation a cop gives you, he gave to you WITH YOUR CONSENT!! That means, when he/she asks to see your license and you hand it over, you have just ACCEPTED HIS/HER OFFER TO CONTRACT!! If you hand over ANY government issued ID, you're SCREWED!! They'll tell EACH teen that the OTHER teen admitted to this and this or that and that, in hopes that the teen in their car will "Confess." I am a 63 year old mother and granny and have seen the incredible change in police officers. In my teen days they were truly PEACE OFFICERS. When my children were teens, I noticed a huge change in the cops' mandate!! They were no longer Peace Officers, but rather, "Law Enforcement Agents." They were no longer concerned about "peace" but rather whether you were obeying the Highway Traffic Act. They were most concerned about REVENUE!! Today, they are nothing more than "tax collectors." When the local, state or national authorities declare marshal law, your constitutional rights can also be suspended, depending on the particulars of the marshal law declaration. Also, the Patriot act did in fact suspend many constitutional rights in some circumstances. Constitutional rights can be suspended during declared wars. That is, when the President of the United States, formally asks the Congress to declare that a state of war exists between the United States and another foriegn state, or when a State of War exists between two or more of the United States. (Remember the civil war?). A state of war cannot be declared against a terrorist organization, (contrary to what Bush thought). The last time a war was officially declared was WWII. The last time constitutional rights were suspended was WWII. The Constitution does not guarnatee that you will always have your rights, but simply you cannot be deprived of them, without DUE PROCESS OF LAW. A declaration of war, is DUE PROCESS OF LAW. The Patriot Act is DUE PROCESS OF LAW. The question of the Patriot Act now is it is constitutionally legal, to deprive people of their Constitutional Rights. I would love to see a lawsuit brought to challenge the constitutionality of the Patriot Act. Finally, in the event of an insurrection against the United States of America, by a person, or persons of the United States of America, or any other nation, whereas the the actions of said persons are actively engaged in acts of war, even though no war has been declared, are not entitled to their Constitutional Rights, but their rights are protected by the Geneva Conventions Treaty covering prisoners of war, as prisoner of war. The rights of prisoners of war are not as protective as our constitutional rights, but do provide basic human rights protections, as well as protections with regard to tortue, and interrogations. |

That said, I know that the police will act according to their nature and enforce these violations of the Constitution. Quoting: Eyes Wide OpenWell, in theory, I do agree with you, but unfortunately, we don't determine the constitutionality of any law. That is left up to the justices on the Supreme Court, that is unless you are one of those judges, in that case, I would urge you to declare the law null and void as it does violate the constitution. <grin>. In any event, the Patriot Act is the biggest set back to our liberties and freedoms all because Bush wanted to be a bully. I personally feel Bush should be tried for war crimes for what he has done. |
