Has an active duty cop ever been tried for murder?

Now the question here will be this: if you have no reasonable expectation that the person you are dealing with is a police officer, do you have to follow their orders just because they claim to be an officer of the law?

While the obvious answer is no, I think that the courts will do a Nazi 180 and claim that we do indeed have to follow all orders from the police, even if there is no way to determine if you are dealing with the police or just some armed thug on the street.

So I will put twenty down on tyranny to win out on this one. Any takers?

KASOTA, MINN. -- A 24-year-old man shot and killed Monday afternoon by a sheriff's deputy had gotten into a verbal and physical altercation with the deputy, authorities said today.

But eyewitnesses said today that Tyler Heilman, of Kasota, was standing with his hands up at the time he was hit by at least two bullets.

"I'm done, man, I'm done -- what the hell?" were Heilman's final words, according to Kris Hoehn, who was standing nearby in the parking lot of an apartment complex.

Minnesota Bureau of Criminal Apprehension spokesman Andy Skoogman today identified the deputy as Todd Waldron, 37, an investigator and 10-year veteran of the LeSueur County Sheriff's Office. Waldron, who has been placed on a standard paid administrative leave, has no record of the use of force, Skoogman said.

"He point-blank murdered my son, my only child," Heilman's father, Mark, said, adding that his family may hire a lawyer to conduct a separate investigation of the shooting.

The state bureau has begun the official investigation of the shooting.

Heilman and Hoehn had been swimming in the Minnesota River when they drove to the Valley View Apartments, where several friends lived, to get something to eat. Soon after they got out of the car, Waldron's unmarked police vehicle pulled up.

According to Skoogman, Waldron had been working undercover on an unrelated case in Kasota, about 60 miles southwest of the Twin Cities, when he noticed a car driving erratically at a high rate of speed. He followed the car until it pulled into the parking lot of the apartment complex.

Waldron tried to arrest Heilman, but was caught in a verbal and physical confrontation, Skoogman said.

The deputy demanded to know who had been driving and asked the men to produce their drivers' licenses, but didn't identify himself as a law enforcement officer, Hoehn said. He said Heilman and Waldron began "wrestling" and Heilman pinned the deputy to the ground when he spotted the badge Waldron was wearing on his belt.

Heilman stood up, holding his hands in the air, Hoehn and another witness, Joelne Manderfield, said, adding that they didn't hear Waldron say anything. He fired four shots, Skoogman said, adding that it's not yet clear how many hit Heilman. Hoehn said he saw two bullet wounds in Heilman's chest.

Heilman turned the corner of the apartment building and collapsed, where Manderfield said she and other witnesses unsuccessfully performed CPR on him.

"He didn't deserve this fate," Hoehn said. "It shouldn't have happened. I was absolutely terrified."

Waldron suffered minor injuries. Although witnesses said a woman nearby was grazed by a bullet, that account is still being investigated.

.No weapons were found in Heilman's car.

LE CENTER, Minn. — State investigators say the southern Minnesota sheriff’s deputy who shot an unarmed man dressed only in swimming trunks is a 10-year law enforcement veteran.

The Bureau of Criminal Apprehension says 37-year-old Todd Waldron was in an unmarked vehicle and wearing plain clothes when he shot 24-year-old Tyler Heilman on Monday in the Le Sueur County community of Kasota.

Few additional details were released today.

Jolene Manderfield saw the shooting. She tells the Free Press of Mankato, Minn., that Heilman was wearing nothing but his swimming suit at the time.

BCA spokesman Andy Skoogman says investigators are asking the community to withhold judgment until all the facts are in. He says Waldron was working on another case when he saw a car driven by Heilman speeding and swerving erratically.

It's clear this officer is a hero, he stopped a man without a shirt on for driving in a "crazy" manner and had to put him down for OUR safety.

It's the only job where you get to kill people and get away with it, outside of the military, but solders are more likely than cops, to get killed, so in reality policing is mainly for chicken shit killers.

The victim was a young dad himself.

One of the articles said he also worked part-time at a few departments. What this tells me is that he wasn't that good to be picked up full-time by any police department.

He sounds like he had problems. It would be interesting to know more about his background.

Sometimes retired cops will work part-time or as a reserve but if a young guy in his thirties is doing it you know something is wrong and no one is hiring him full-time.

Tyler Heilman's girlfriend, Abby Bauleke, stopped by the shooting scene Tuesday afternoon and she wonders how she will explain what happened to their son.

"How do you tell a 4-year-old Daddy's not going to be coming home, Daddy's gone," she said.

The victim had a girlfriend, with whom he had a 3-year-old son. He wasn't working at the time of the shooting because he had an accident this past Mother's Day which resulted in a blood clot.

Instead of just testing Heilman for drugs and alcohol why dont they find out what Waldron was on? He definately shouldnt be able to get a job around here and if anywhere he shouldnt be able to carry a gun or even a taser ever again. He was taking his advantage of being a cop to a whole new level and should not be on paid leave for murder. If anybody else other than a cop shot and killed someone they wouldnt be paid for it, why should a cop? Especially when its still under investigation. If anything he should get reimbursed for his leave if he really had a reason for doing it. The only reason they need so long to figure it all out is so they can find out a easy way to get the cop a lesser sentence. If I was that cop I would be leaving state until court came around and never stick my head out in public again. He should never be on the force again and shouldnt even be able to be a security guard at a college just because he has so much training. If he did have the training he shouldnt been able to assess the situation without even having to take the gun out of his holster. It says he was trained for deadly force, doesnt that mean he should be able to hold his weight in a fight. By the pictures it looks like he is a big enough man to take care of himself. It should have never escalated to shooting someone over a traffic stop. If anything fire your gun up in the air that way all action would stop and noone would have to get hurt. I live in Kasota, police rarely have to come here and are usually pretty lenient towards citizens. It once was a quiet place without gunshots and murder. [email protected]
