Actually, you are completely incorrect. No one will be able to sue for Defamation if the report is truthful. Further, governments, religions and nations are unable to sue for defamation because under US law, they are all "public figures." Pursuant to US Case Law [see "New York Times v. Sullivan", US Supreme Court]) public figures are subject to a completely different standard under the law. In order for a "public figure" to file a defamation suit, the information released must meet the following five criteria: 1) The information is false, AND; 2) The person making the utterance, KNEW it was FALSE but said it anyway, AND; 3) The person made the false utterance with malicious intent, AND; 4) The false information was WIDELY DISSEMINATED, and; 5) The dissemination caused actual financial harm to the person about which the information was uttered. Unless ALL FIVE criteria above are met, a "public figure" is unable to file suit for Defamation, slander and the like. For everyone else who is not a public figure, Item #1 above, still applies. If the report that they were spied upon is TRUE, none of them can file suit because the release of TRUTHFUL information is protected speech. |
