The Founders set up the Gov to be a Represented Republic. Democracy is "mob rule" and I suspect that is the reason we all hear the talking heads refer constantly to "our democracy!" At what point does one knowingly offer / surrender the state the intangible property right to marry without a license? (no license needed before the civil war) and... what is the compensation offered by the state for surrendering said right, to make said exchange binding? no consideration = no binding contract / agreement = no authority to license = void license.
