De Santis has no power to regulate something like that in a private nursing home. Many things in nursing homes gov can regulate, that may not be one of them and they do it through the license agreement which is probably drawn up with the help of the legislature.

You are pretty much required to refuse their business if you don't like the way they do it.

If you could discover they have some sort of requirement set by the state in their license application that specifically addresses your concern, you should take legal action.

Even if they have such a requirement I bet the lawyers already advised them they could get away with it, or at least advised them they had a 50/50 chance after a long court battle.
