Hence roe v wade is overturned. It was bad law, used as a precedent for all sorts that the Constitution does not allow. The federal government cannot ban abortion this is what the overturning means, and so it goes back to the people, via the states, to decide.

It's also based on the 14th amendment, for the same reason that they used for Roe v. Wade, in fact...

Now the intent of the 14th amendment WAS to make certain laws couldn't be made to hurt black people in the South, but it doesn't mention anything that sounds like it would make gay marriage or interracial marriage legal or illegal, in particular.

The idea is that it kind of hand waved at it, as a freedom. Which, it might have for interracial unions. Certainly not for abortion, and definitely not for gay marriage.

*I am for those things, but if it didn't work for Roe, these other things could well be challenged in the future.

A state giving a licence is permission, correct. But it is permission from yourself.. you have given the state your consent. This is what governance by consent looks like.
