The Racketeer Influenced and Corrupt Organization Act (RICO) was passed by Congress in 1970 under the Crime Control Act, with the declared purpose of seeking to eradicate organized crime in the United States.

The first thing that jumps out is that in order to be prosecuted under RICO laws, you have to be a part of a defined enterprise engaged in this activity. Could be a corporation, a partnership, LLC, or some other defined group.

Second: there are certain criminal violations that trigger a RICO violation. It requires a pattern of racketeering activity requires at least two acts of racketeering activity committed within ten years of each other.

Murder
Kidnapping
Extortion
Arson
Robbery
Bribery
Dealing in obscene matter
Dealing or trafficking a controlled substance or chemical
Bribery
Counterfeiting
Theft
Embezzlement
Fraud
Wire Fraud
Mail Fraud
Obstruction of justice
Slavery
Money laundering
Commission of murder-for-hire
Embezzlement of union funds
Bankruptcy fraud or securities fraud
Criminal copyright infringement
Human smuggling
Acts of terrorism

The government need not prove that the defendant agreed with every other conspirator, knew all of the other conspirators, or had full knowledge of all the details of the conspiracy.

All that must be shown is: (1) that the defendant agreed to commit the substantive racketeering offense through agreeing to participate in two racketeering acts; (2) that he knew the general status of the conspiracy; and (3) that he knew the conspiracy extended beyond his individual role.

Generally, those convicted of Federal Racketeering/RICO crimes are sentenced to a maximum 20 years and $25,000 fines per count. So for a Federal RICO case at least two offenses in a ten-year period must be charged and in many cases, far more specific charges are brought.

Anyone facing Federal RICO charges will be facing other charges as well so that a loss of the case generally means spending the rest of one’s days in prison.

Thinking this through, it seems like the RICO charges could only be brought against private organizations not government agencies.

So for instance a campaign organization (and their paid contractors) could be subject to this law, but any additional government employees acting in concert, toward a common cause, in the same criminal conspiracy, would be not be subject to the RICO law.

Govt employees could however be brought up on standard conspiracy charges, as they were acting outside the scope of their employment.

Individually, they don't have much money anyway so that might not make too much difference, especially when you think about the civil RICO aspects where monetary damages are involved.
