HELENA - Montana lawmakers overwhelmingly passed what its sponsor called the nation´s most strongly worded criticism of the federal Patriot Act on Friday, uniting politicians of all stripes.

The resolution, which already galloped through the Senate and passed the House 88-12 Friday, must survive a final vote before it officially passes.

Senate Joint Resolution 19, sponsored by Sen. Jim Elliott, D-Trout Creek, says that while the 2005 Legislature supports the federal government´s fight against terrorism, the so-called Patriot Act of 2001 granted authorities sweeping powers that violate citizens´ rights enshrined in both the U.S. and Montanan constitutions.

The resolution, which does not carry the weight of a law but expresses the Legislature´s opinion, encourages Montana law enforcement agencies not to participate in investigations authorized under the Patriot Act that violate Montanans´ constitutional rights. It requests all libraries in the state to post a sign warning citizens that under the Patriot Act, federal agents may force librarians to turn over a record of books a person has checked out and never inform that citizen of the request.

The resolution asks Montana´s attorney general to review any state intelligence information and destroy it if is not tied directly to suspected criminals. It also asks the attorney general to find out how many Montanans have been arrested under the Patriot Act and how many people have been subject to so-called "sneak and peaks," or government searches of a person´s property without the person´s knowledge.

Elliott, a Democrat and rancher from northwestern Montana, sponsored the resolution, but it garnered support from Republicans on the far right of the political spectrum.

"Sometimes we just take liberty for granted in the country," said Rep. Roger Koopman, R-Bozeman, who keeps a plant called "the Liberty Tree" on his legislative desk.

Koopman said his Liberty Tree was "blooming for this bill."

"Frankly, what it says to me is that civil liberties are a bipartisan issue in Montana," said Rep. Rick Maejde, R-Trout Creek, who led the House debate for the resolution.

Elliott said he was "very, very pleased" the resolution had such support.

"Montana isn´t the first state that passed a resolution, but this resolution is the strongest statement against the constitutional violations of the Patriot Act of any state and almost every city or county," he said.

Twelve representatives - all Republicans - voted against the measure, including Rep. Bob Lake, R-Hamilton.

"I don´t like resolutions because they do absolutely nothing," he said in an interview after the vote. He also said the resolution was too vague. Is it a sacrifice of personal liberty to not be able to take a gun on an airplane? he asked. Is that the kind of thing this resolution objects to?

"So, they´re going to get this thing back in D.C. and say, ´O.K., Montana doesn´t like what we´re doing. So what?,´ " he said. "It has no meaning to it."

AC 8082, true, the resolutions do not carry weight of law. It serves as an indication that Americans are not happy with these bullshit laws intended to protect us from turrrrists, when we know the real turrrrists are all over DC.

If any representative brought forth proposed legislation against the Patriot Act(s) they´d be Wellstoned ahora mismo.

Text:

Whereas, the State of Arizona houses a diverse population, including citizens of other nations, whose contributions to the community are vital to its character and function; and

Whereas, the United States Constitution guarantees all persons living in the United States the fundamental rights, including freedom of religion, speech, assembly and privacy; protection from unreasonable searches and seizures; due process and equal protection; equality before the law and the presumption of innocence; access to counsel in judicial proceedings; and a fair, speedy and public trial; and

Whereas, the USA Patriot Act, signed by President George W. Bush on October 26, 2001, has a number of provisions that contradict these rights, fundamentally alter the nature of our civil liberties and do little to increase public safety; and

Whereas, provisions in the USA Patriot Act and related Executive Orders that may violate the constitution and the rights and civil liberties of Arizona residents include those that significantly expand the government´s ability to access sensitive medical, mental health, financial and education records about individuals and lower the burden of proof required to conduct secret searches and telephone and internet surveillance; that give law enforcement expanded authority to obtain library records and prohibits librarians from informing patrons of monitoring or information requests; that give the attorney general and secretary of state the power to designate domestic groups, including religious and political organizations, as "terrorist organizations"; that grant power to the attorney general to subject citizens of other nations to indefinite detention or deportation even if they have not committed a crime; that authorize eavesdropping on confidential communications between lawyers and their clients in federal custody; and that limit disclosure of public documents and records under the Freedom of Information Act; and

Whereas, Department of Justice interpretations of the USA Patriot Act and related Executive Orders particularly target Muslims, people of Middle Eastern and South Asian decent and citizens of other nations, encouraging racial profiling by law enforcement and hate crimes by individuals in our communities; and

Whereas, Alaska, Maine, Hawaii, Vermont, Idaho and three hundred fifty cities, including Flagstaff and Tucson, have already passed resolutions protecting individuals´ rights to privacy and confidentiality and opposing the USA Patriot Act.

Therefore

Be it resolved by the Senate of the State of Arizona, the House of Representatives concurring:

1. That the Legislature affirms its strong opposition to terrorism but also affirms that any efforts to end terrorism not be waged at the expense of the fundamental civil rights and liberties of the people of Arizona, the United States and the world.

2. That the rights of all people, including United States citizens and citizens of other nations who live in the State of Arizona, be affirmed in accordance with the Bill of Rights and the Fourteenth Amendment to the United States Constitution.

3. That to the extent legally possible, no employee or department of the State of Arizona officially assist or voluntarily cooperate with investigations, interrogations or arrest procedures, public or clandestine, that violate individuals´ civil rights or liberties as specified in the United States Constitution.

4. That all private citizens and organizations, including residents, employers, educators and business owners, demonstrate similar respect for civil rights and liberties, particularly conditions of employment and cooperation with investigations.

5. That the Legislature calls on our United States Representatives and Senators to monitor the implementation of the USA Patriot Act and related Executive Orders and actively work for the repeal of those provisions that violate fundamental rights and liberties as stated in the United States Constitution.

6. That the Secretary of State of the State of Arizona transmit copies of this Resolution to each Member of Congress from the State of Arizona.

States finally starting to go against the word of the federal government? Perhaps they´re some hope for us yet... in essence, each state has the ability to become it´s own country should it become necessary. A true fight against the real evils of the world, the aristocratic oligarchy that has siezed control of not only our government but global government, is something I´d fight for.

Death to the zionists, death to the bankers, those are the only two enemys I´d ever consider "fighting" over.. not the imaginary enemies created by our own actions in the middle east and around the world.

Patriot Act of 2001?

Hate to be a party pooper; but does it include Patriot Act II? Patriot Act of 2004??? I certainly hope so; because the Patriot Act of 2001 is already null and void; being replaced by the more extreme Patriot Act II.

Anyone have any more information on this?

The federal government is accountable and answerable to the states, not the other way around.

Bear that in mind.

Time to call a Constitutional Convention for all the states to challenge the federal government and end its complete authority for good.

Oh give me a break. The Montana legislature is as chicken as any of the rest of them. All they did was to write into a bill that they reccommend that state and local law agencies not comply with the feds in cases that are being run under the patriot act.
