Anonymous Coward 12/08/2005 10:06 AM Report Abusive Post Report Copyright Violation | Arizona did, too, but Jones did not report it, nor did it receive much in the way of in-state media reporting: SCR 1031 - Opposing the Patriot Act Concurrent Resolution Text: Whereas, the State of Arizona houses a diverse population, including citizens of other nations, whose contributions to the community are vital to its character and function; and Whereas, the United States Constitution guarantees all persons living in the United States the fundamental rights, including freedom of religion, speech, assembly and privacy; protection from unreasonable searches and seizures; due process and equal protection; equality before the law and the presumption of innocence; access to counsel in judicial proceedings; and a fair, speedy and public trial; and Whereas, the USA Patriot Act, signed by President George W. Bush on October 26, 2001, has a number of provisions that contradict these rights, fundamentally alter the nature of our civil liberties and do little to increase public safety; and Whereas, provisions in the USA Patriot Act and related Executive Orders that may violate the constitution and the rights and civil liberties of Arizona residents include those that significantly expand the government´s ability to access sensitive medical, mental health, financial and education records about individuals and lower the burden of proof required to conduct secret searches and telephone and internet surveillance; that give law enforcement expanded authority to obtain library records and prohibits librarians from informing patrons of monitoring or information requests; that give the attorney general and secretary of state the power to designate domestic groups, including religious and political organizations, as "terrorist organizations"; that grant power to the attorney general to subject citizens of other nations to indefinite detention or deportation even if they have not committed a crime; that authorize eavesdropping on confidential communications between lawyers and their clients in federal custody; and that limit disclosure of public documents and records under the Freedom of Information Act; and Whereas, Department of Justice interpretations of the USA Patriot Act and related Executive Orders particularly target Muslims, people of Middle Eastern and South Asian decent and citizens of other nations, encouraging racial profiling by law enforcement and hate crimes by individuals in our communities; and Whereas, Alaska, Maine, Hawaii, Vermont, Idaho and three hundred fifty cities, including Flagstaff and Tucson, have already passed resolutions protecting individuals´ rights to privacy and confidentiality and opposing the USA Patriot Act. Therefore Be it resolved by the Senate of the State of Arizona, the House of Representatives concurring: 1. That the Legislature affirms its strong opposition to terrorism but also affirms that any efforts to end terrorism not be waged at the expense of the fundamental civil rights and liberties of the people of Arizona, the United States and the world. 2. That the rights of all people, including United States citizens and citizens of other nations who live in the State of Arizona, be affirmed in accordance with the Bill of Rights and the Fourteenth Amendment to the United States Constitution. 3. That to the extent legally possible, no employee or department of the State of Arizona officially assist or voluntarily cooperate with investigations, interrogations or arrest procedures, public or clandestine, that violate individuals´ civil rights or liberties as specified in the United States Constitution. 4. That all private citizens and organizations, including residents, employers, educators and business owners, demonstrate similar respect for civil rights and liberties, particularly conditions of employment and cooperation with investigations. 5. That the Legislature calls on our United States Representatives and Senators to monitor the implementation of the USA Patriot Act and related Executive Orders and actively work for the repeal of those provisions that violate fundamental rights and liberties as stated in the United States Constitution. 6. I certainly hope so; because the Patriot Act of 2001 is already null and void; being replaced by the more extreme Patriot Act II. Anyone have any more information on this?
