Don't be surprised. An old lady got sued by someone who tried to rob her because her roof was covered in snow and the theif fell and sipped into her pool. She almost got put in jail and was charged 10k I think. |

Anonymous Coward User ID: 1173906 United States 05/07/2011 01:57 PM Report Abusive Post Report Copyright Violation | research to see if your state has adopted "the castle doctrine" this doctrine allows someone to use deadly force to prevent someone from entering your home if you have reasonable cause to believe they intend to harm or kill you or any of the other occupants in the house. in many states, there is no duty to retreat. however, you can't just shoot at people who come on your property unless they were shooting at you or something. if someone comes on your property and you don't want them there, you have the right to order them to leave your property. if they do not leave, you call the police and the person will be arrested/cited for criminal trespass. if there is someone specific that you don't want on your property, you can contact your local police dept and have a "no trespass order" taken against that party. that way if they come onto your property in the future, they will automatically be arrested. also, if you post a no trespassing sign on your property, that alone qualifies as an order not to come on your property, and anyone who disregards the sign and comes onto your property anyway is already guilty of trespass without the property owner having to first make a verbal order to leave. hope this helps |

It does get reviewed and heard by a Grand Jury...they actually decide whether or not to bring charges...usually abiding by the recommendation of the local DA. Obviously, if you threatened the dead guy last week, they're gonna be VERY suspicious. |
