While police generally need a warrant to search you or your property -- during a traffic stop, police only need probable cause to legally search your vehicle. Probable cause means police must have some facts or evidence to believe you're involved in criminal activity.

In other words, an officer's hunch without evidence of illegal activity is not enough to search your car. Before searching, he must observe something real. Common examples of probable cause include the sight or smell of contraband in plain view or plain smell, or an admission of guilt for a specific crime. The presentation of any of these facts would allow an officer to perform a search and make an arrest.

Be aware that minor traffic violations (e.g. speeding, broken tail-light, or expired registration) are not considered probable cause.


The major exception to the probable cause requirement for vehicle searches is consent. Most vehicle searches don't occur because police have probable cause. They occur because people get tricked or intimidated into consenting to search requests.

Consenting to a search request automatically makes the search legal in the eyes of the law. And the 4th Amendment doesn't require officers to tell you about your right to refuse. So if you're pulled over, don't try to figure out whether or not the officer has probable cause to legally search you. You always have the right to refuse search requests.

If you refuse consent but the officer searches you anyway and finds illegal items, your lawyer can file a motion to suppress -- or throw out -- the evidence in court. If the judge agrees that the officer's search violated the 4th Amendment's probable cause requirements, she'll grant the motion. Unless the prosecution has other evidence, your charges would be dismissed.

Since anyone could put flashing lights on their vehicle, doesn't this open up the possibility of criminals or nut jobs trying to impersonate a police officer with intent of robbery?

Sounds to me that if the bubble gums in your rear view are not attached to an official-looking vehicle, you should immediately dial 911 to confirm before pulling over.

I went through TN about 1.5 yrs. ago on the way to TX. We passed a black and a white SUV(fed) about every 5 miles w/ equipt. set up for about an hour and they were pulling people over and had them spread eagled on their cars. It was very strange.

On the way back thru TN I got a speeding ticket so I asked the state trooped what was going on the day before and she said probably the Drug Task Force was at work. Then I said, "well, they should be checking out the CIA as they the ones that bring all the illicit drugs in". Then she said "tell me something we don't already know" and my jaw dropped. Then after giving me a ticket. She said "they are cutting troopers by 50% and municipal workers too in the near future". Finally, her last words were "the war is coming here soon". I was dumfounded.

John Moore had said 6 months ago that prior to the natural disasters that the Government was preparing for, they would use the excuses of terrorism and economic turmoil as an excuse to ramp up the security and to get troops into position, and to get other personnel strategically positioned into certain areas of concern.

Then, one month after John made that statement, you had the staged death of Bin Laden as well as a drumbeat in the media about threats of terrorism, and then DHS began using that as a cover for alot of these urban warfare drills and other types of martial law drills that they've been doing (like Eagle Horizon as well as Mountain Guardian in Denver on 9/23).

Now you have the economic protests going on around the globe and in the U.S. (Occupy Wall Street, etc), and they can now ramp things up even more in response to that (and OWS does appear to be an orchestrated movement, gov't planted the seeds and is helping those seeds to germinate and grow).

It's a ramp up in security and preparedness for a series of natural disasters and the related emergencies that will result from those disasters, and they keep using the guise of "terrorism and economic turmoil" as the excuse.

Saw this coming some months ago when USAJOBS had two job postings for these positions which were many. Half of the positions were for those who would work with a dog and the other half was for just inspecting trucks. These were entry level positions and if hired they sent you to Oklahoma I believe for something like five weeks of training. The paid I believe was somewhere around $36,000 starting out. This will be the norm and spread to the rest of the country. Also if I remember correctly, these TSA employees will have to move about from location to location doing these inspections as it's not a very family friendly job as they will be away from home alot going from state to state coming to your home town eventually. Question is, do I really need a job that bad?

I'm tarting to think that they're counting on us to react to all of this. Everything they've been doing seems very drastic and very sudden. If you want to boil a frog you don't just throw him in hot water, he'll jump out. You put the frog in the warm water and let it slowly heat up to a boil. I really think they want us to react violently so they can do something even more drastic and not look like the bad guys. I think the "shit" flinging toward the "fan" as we speak and the peoples reaction decides when it will hit it. Just a thought
