WTF?!?! Sullivan Mulls Contempt Charge Against Michael Flynn

None of his comments or actions make any sense in this trial.

Back and forth from calling General Flynn a traitor to this country, to apologizing for that comment, then almost begging him to withdraw his plea, to Powell finding the exculpatory evidence, to this stunt.

You'd think that he would love to toss this case given that he was lied to by the prosecutors and Flynn's former lawyers.

He's behaving as if he's being threatened.

Perjury won't fly as the DOJ won;t prosecute.

The Judge however could issue a contempt of court for misleading he court and nothing the DOJ can do about it.

Contempt of court is a misdemeanor and who cares...90 days in jail!

Since when can a judge prosecute someone for perjury? A judge can find someone in contempt in his court, but AFAIK perjury requires a prosecutor and I doubt the DOJ will do that now.

Plus, people withdraw guilty pleas all the time. I think that withdrawing the plea just means the prosecution would have to go back to court and prove its case. And Barr already said he won't do that.

Also, I've never heard that Flynn was ever read his Miranda rights. You know "You have the right to remain silent. Anything you say can be used against you in a court of law. etc."

Yet another reason why we need Trump in 2020. He's replacing these F'ing communist liberal pig judges with Law Abiding, Country and Family Loving conservative judges.

I don't think he did mislead the court. His former lawyers withheld the evidence without his knowledge.

If anyone is guilty of perjury it's them and the prosecutors that have unexpectedly resigned out of the blue. Why resign from all their assigned cases if they didn't do anything wrong?

That's why Obama mentioned perjury instead of lying to FBI. Obama knew Flynn was innocent and by pleading guilty "lied" to the court. Obama also knew that a "contempt" charge will land Flynn in jail and Trump can't pardon him.

Obama is evil. They get off scott free because they have judges in the US that have their back and change the rules as they go along to make sure they "get their man".

Never have I heard of a judge calling in a judge to argue a case in place of the DOJ or prosecutor. It simply isn't done.

This will set a precedent where prosecutors can't ever dismiss charges again if the judge has a hard on for the defendent! The judge will simply call someone else in to argue for the prosecution? It's fucking crazy!

No the judge simply watches too much CNN and Madcow, bought all the lies (you can tell by him calling Flynn a traitor and then having to apologize for the comment) and is part of the RESIST movement. He's been listening closely to Comey and Brennan and Obama when they all make their little tweets about holding on, hanging in there, they will prevail, blah, blah, blah.

This is evil that has permeated the rule of law. The Deep State has majority of judges on their side now. The Dems control all aspects of this country. The Fed government employees, the Intel agencies, the Media and now the courts. And they use them very effectively to thwart their political opponents. What is supposed to be impartial is simply not.

I'll bet you there's some dirt on Sullivan somewhere and he wants to cover his own ass.

This judge is simply not going to let Flynn not see jail time. He is a Democrat before he is a judge. He has been waiting for months to sentence Flynn (he thinks he's a traitor) and he isn't going to let Barr or Trump take away his scalp.

Here is some help—if truth and precedent represent your true concern. Your statement is entirely false. However, it does explain the damage to the Rule of Law throughout your administration.

First, General Flynn was not charged with perjury—which requires a material false statement made under oath with intent to deceive.1 A perjury prosecution would have been appropriate and the Rule of Law applied if the Justice Department prosecuted your former FBI Deputy Director Andrew McCabe for his multiple lies under oath in an investigation of a leak only he knew he caused.

McCabe lied under oath in fully recorded and transcribed interviews with the Inspector General for the DOJ. He was informed of the purpose of the interview, and he had had the benefit of counsel. He knew he was the leaker. McCabe even lied about lying. He lied to his own agents—which sent them on a “wild-goose-chase”—thereby making his lies “material” and an obstruction of justice. Yet, remarkably, Attorney General Barr declined to prosecute McCabe for these offenses.

Applying the Rule of Law, after declining McCabe’s perjury prosecution, required the Justice Department to dismiss the prosecution of General Flynn who was not warned, not under oath, had no counsel, and whose statements were not only not recorded, but were created as false by FBI agents who falsified the 302.

Second, it would seem your “wingman” Eric Holder is missing a step these days at Covington & Burling LLP. Indelibly marked in his memory (and one might think, yours) should be his Motion to Dismiss the multi-count jury verdict of guilty and the entire case against former United States Senator Ted Stevens. Within weeks of Mr. Holder becoming Attorney General, he moved to dismiss the Stevens prosecution in the interest of justice for the same reasons the Justice Department did against General Flynn—egregious misconduct by prosecutors who hid exculpatory evidence and concocted purported crimes.

As horrifying as the facts of the Stevens case were, they pale in comparison to the targeted setup, framing, and prosecution of a newly elected President’s National Security Advisor and the shocking facts that surround it. This case was an assault on the heart of liberty— our cherished system of self-government, the right of citizens to choose their President, and the hallowed peaceful transition of power. END QUOTE
