Trespass and disorderly conduct.

The property was not government land but privately owned and leased to the State meaning the trespass enforcement was legal and the officers followed proper law.

The store owner never said they were doing anything wrong other than filming. He would have to prove that they were trespassing which he didn’t.

If they were in the store when the police arrived that would be different.

The police did not arrest him and she even admitted on the phone call that it was legal for him to film .

Cops CANNOT demand your ID under threat of arrest unless you are operating a vehicle.

The woman on the phone who made the complaint said that she wasn’t from Idaho so it’s weird that people can film you in public.

Where does she live? Obviously not in the US

He committed no crime, both her and the store owner admit it, yet both wanted to leverage a trespassing charge against him, which as he said, is deprivation of rights under color of law.

There is no law in Idaho that requires a person to carry or even own an ID so how can it be a law for you to present one or be arrested?

I have been trying to support cops, I really have been. Hell, two friends that served with me in special warfare are SRT today. However, there are too many egotistical, power tripping bad cops in this day and age. Far too many and the good cops, like my friends, do nothing about it.

These cops don’t know the laws and detain or even arrest you illegally. Then you sue and judges support the police against you knowing full well you can’t afford the time and money to take it to the supreme court level.

I get into it ALL the time with my cop friends. I want to back the blue, because I know they have it tough.. but damn, they need to stop using small traffic infractions to pull drug search shit on people.
