It doesn't matter if we have the right, as long as we have the ability.
 Quoting: Anonymous Coward 8843961

If anything was ever considered, consider this: The right to keep and bear arms is the ability. It may not be lawful but it certainly is necessary.

Necessity + Ability = Implied Right

At least that is the formula given to us by government.

Our country was founded on ordinary people taking up arms against the tyranny of the government which was over it at the time.

Patriot act, ndaa, botched economy, and voter fraud. This is beyond enough to rebel. So yes, we have a right.

Dennis v. United States, 341 U.S. 494, 71 S. Ct. 857, 95 L. Ed. 1137 (1951)

The only problem is that the Supreme Court, like the other two branches of government, enjoys it's very existence by consent of the People.

A citizen may be determined to not have a right to take up arms, but the People are under no such restriction.

Citizens in a democracy don't have any rights, only privileges granted by the federal government (legal entity) who can also take them away. Citizens are voluntary slaves.

However, the people in a constitutional republic have all their natural god given rights intact if they exercise them properly and don't give them away voluntarily.

And self-defense is obviously a natural right, if federal agents ie mercenaries working for a foreign corporation, come to take their guns (private property), those agents become criminal robbers by definition violating common law, and the people have the right to defend themselves!

I agree with the Anonymous poster from Germany he's got a good point. But of course it's our right to defend ourselves whether it be against an intruder or a damn tyrannical government to me it's worse to sit there and take it then it is to fight it, and it seems like in this day and age the powers that be expect us all to just sit there and let it happen excuse my language but fuck that.

Revolt against the United States

During the mid-1940s, various pro-independence groups, such as the Puerto Rican Independence Party, which believed in gaining the island's independence through the electoral process, and the Puerto Rican Nationalist Party, which believed in the concept of armed revolution, existed in Puerto Rico. On October 30, 1950 the nationalists, under the leadership of Dr. Pedro Albizu Campos staged uprisings in the towns of Ponce, Mayagüez, Naranjito, Arecibo, Utuado (Utuado Uprising), San Juan (Nationalist attack of San Juan) and Jayuya.

File:Blanca Canales.JPG
Blanca Canales, nationalist leader of the Jayuya Uprising

The most notable of these occurred in Jayuya in what became known as El Grito de Jayuya (Jayuya Uprising). Nationalist leader Blanca Canales led the armed nationalists into the town and attacked the police station. A small battle with the police occurred; one officer was killed and three others were wounded before the rest dropped their weapons and surrendered. The nationalists cut the telephone lines and burned the post office. Canales led the group into the town square where the illegal light blue version of the Puerto Rican Flag was raised.[95] In the town square, Canales gave a speech and declared Puerto Rico a free Republic. The town was held by the nationalists for three days.[96]

The United States declared martial law in Puerto Rico and sent the Puerto Rico National Guard to attack Jayuya. The town was attacked by U.S. bomber planes and ground artillery. Even though part of the town was destroyed, news of this military action was prevented from spreading outside of Puerto Rico. It was called an incident between Puerto Ricans. The top leaders of the nationalist party, including Albizu Campos and Blanca Canales, were arrested and sent to jail to serve long prison terms.

Griselio Torresola, Albizu Campos's bodyguard, was in the United States at the time of the Jayuya Uprising. Torresola and fellow nationalist Oscar Collazo, were to assassinate President Harry S. Truman. On November 1, 1950, they attacked the Blair House where Torresola and a policeman, Leslie Coffelt, lost their lives. Oscar Collazo was arrested and sentenced to death. His sentence was later commuted to life imprisonment by President Truman and he eventually received a presidential pardon.[97]

Sinse then the Citizen rights to own guns were restricted and violation of second amendment had remained constant up to this date .... (Next to be implemented in all USA )

Puerto Rico people had being the ONLY STATE in AMERICA with the BALLS to raise against federal domminion and had paid a dear prize ....
Thoose that learn from history are not bound to repeat it ..

Re: Private Citizens have No Right to take up arms against the Government.
so may be we should give back the US and all our north American land to England....private citizens do not have the right.....
well it was just that back then....private citizens or they were call subjects of the king of England back then, made a stand.
they used their privately owned guns to fight and Nov 25th 1783 they watched all the men who had controlled them leave.

Following the American Revolutionary War, Evacuation Day on November 25 marks the day in 1783 when the last vestige of British authority in the United States — its troops in New York — departed from Manhattan. After this British evacuation, General George Washington triumphantly led the Continental Army through the city.[1] The last shot of the war was reported to be fired on this day, as a British gunner on one of the departing ships fired a cannon at jeering crowds gathered on the shore of Staten Island, at the mouth of New York Harbor (the shot fell well short of the shore).[2]

The first Liberty Pole was erected on November 25, 1783 at the end of the Revolutionary War. The flag of the new republic, a flag with thirteen stars and bars, was hoisted to the top of this first Pole. Traditionally, poles such as this one were associated with celebrations of peace accompanied by marching, music and other festivities made popular after the British evacuation.

my family's ancestors were there in Brooklyn that day as they pulled the first American flag up the first liberty pole.
and fired those canons as the British boarded there ship and left for home.

i now live 4 blocks from where this event happened!

I'd say arbitration annulled trial by jury (Civil) in favor of corporations. Also, "free" elections...good one.

Still, we are missing the simplest point. The government is telling us we don't have the right-the right to replace them when they screw us and our inalienable rights.

Yet, the dirty "elected" ones can censure or impeach their own for "high crimes and misdemeanors". Try that one for a laugh.

Trial by Jury (common law) = Jury determines LAW & FACT (jury opinion overrides judge's opinion)
