If you said one and now your daughter is there more than half the time...you could be breaking the lease... One tact that I would take to level these ridiculous demands would be to charge them with housing discrimination. I would argue that requiring court documented notice of your times with your children is an excessive burden that violates the fair housing act as amended in 1981 protecting familial status. I would then charge them that all of their actions were baseline motivated by child discrimination in violation of the fair housing act. It doesn't matter if they are tolerant of other children. That is not a sufficient defense for this violation. If one child who plays a musical instrument or dances outside bothers the management to the point that they harass then it becomes discrimination. Children have the right to be children. I know that you are planning your arguments based off of the lease language and whether or not the lease language is enforceable. I am betting that they have already prepared for that line of fight. If you take the fight somewhere they are not prepared for they usually back off immediately. If they don't back off, you don't have to finance your own battle. You can have the state fight your battle and collect fines to compensate you for the discrimination. |

While they have absolutely moral reason to get these reports and I'd say no too, they can evict you for not providing them on the basis that they can no longer determine your credit worthiness. No Housing Court Judge would evict a tenant for failure to provide this information after he has signed a lease. That is a fact. I would have to disagree with this. Not on a legal basis, but on an anecdotal basis. All that complex has to do is make up a random violation of terms or say there came to light discrepancies in the credit check as originally performed, and there goes the eviction. They know an individual in an apartment with general credit availability is not going to have the funds to fight them, so it becomes an issue of how far does someone want to take it in risking everything they have vs. a company that has 100+ times the assets available. Companies of all types do this all the time knowing people can't fight them, shouldn't be news to anyone. |

Of course your attorney could and will be able to easily access that information, if it isn't his usual arena, then that could take a little research on his part. This could save some time. Something is not right. I have a young couple (newlyweds with a newborn) that just moved into an apartment. The land lord put a video camera outside there door to monitor them. The landlord decided they have too much traffic and tried to evict them after the first month. They got a lawyer that is helping with the harassment. Even though Im sticking up for the young couple. Being a land lord is hard...People stiff you, sue you and try to do anything else to get out of paying rent. Then no matter how bad theyre trashing your place....you have to wait 90 days to get the little fuckers out. Years ago a friend ran a movie theater. The owner would only hire ex-convicts for him to train. One lady came out and told me shes rented houses over 30 years and NEVER left a place paying a months rent. She said when ever it came time to leave she would open a law suit...she would normally get all of her past rent back and then some.... |

It doesn't mean that agreements don't change or that god forbid and something happens and you don't get your child support. That is your personal information. It probably has your social numbers on it somewhere and maybe even your kids numbers. My advice is to say, okay, yeah and then forget about it. You don't want to piss people like this off. Bide your time and then move the hell away. Hopefully they won't find a way to get more involved in your life like false CPS allegations and stuff like that... so just make nice, but don't give them anything. Avoid contact with these people. |

Ask her to show you the potion of the lease/rules that describes that you are obligated to give her this information. It should at least create a delay in her actions. i asked her that but used different wording. i asked her point blank why, when i already provided verification of my income, household status, student info, etc, does she need to RE-verify? i asked, "why do you need to continually verify my income and household status when i just did all that 6 months ago when i moved into this unit?" Isn't signing the lease agreement the standard for "i am verified and i qualify"? then i asked what type of document can i bring to her that she doesn't already have? that's when she wanted to see my divorce decree. i told her no, that was too invasive. then she got stumped and got on the phone with CHFA lady from the state. |
