WTF? My apartment mgr just demanded to see proof that my child support is court ordered and to see my divorce decree

not the case. i have always had full custody of my kids. the ex sees her maybe 30 days out of the year. my son is grown now, but ex saw him even less. it has always been this way. i am not doing anything subpar with my lease agreement. i am totally legit, above board, they have everything they required.

the state is doing something different. they are requiring new types of proof and demanding court orders on child support.

what burns my ass is they had the nerve to ask to read my divorce decree.

Meeting with your attorney should get it fixed. It certainly seems suspect. One tact that I would take to level these ridiculous demands would be to charge them with housing discrimination. I would argue that requiring court documented notice of your times with your children is an excessive burden that violates the fair housing act as amended in 1981 protecting familial status. I would then charge them that all of their actions were baseline motivated by child discrimination in violation of the fair housing act. It doesn't matter if they are tolerant of other children. That is not a sufficient defense for this violation. If one child who plays a musical instrument or dances outside bothers the management to the point that they harass then it becomes discrimination. Children have the right to be children. I know that you are planning your arguments based off of the lease language and whether or not the lease language is enforceable. I am betting that they have already prepared for that line of fight. If you take the fight somewhere they are not prepared for they usually back off immediately. If they don't back off, you don't have to finance your own battle. You can have the state fight your battle and collect fines to compensate you for the discrimination.

I would have to disagree with this. Not on a legal basis, but on an anecdotal basis. All that complex has to do is make up a random violation of terms or say there came to light discrepancies in the credit check as originally performed, and there goes the eviction. They know an individual in an apartment with general credit availability is not going to have the funds to fight them, so it becomes an issue of how far does someone want to take it in risking everything they have vs. a company that has 100+ times the assets available.

Companies of all types do this all the time knowing people can't fight them, shouldn't be news to anyone.

THIS is the best thing i heard so far besides them just dropping the ball. They get grants and loans for data collection. Something with google, facebook, bing, blah blah blah. I hope your attorney can resolve this issue for you quickly. I have to admit, your state has serious constitutional and moral issues in my opinion. I would still call this number Landlord/Tenant Counseling Program (303) 831-1935 offers individuals information on leases, the legal eviction process, security deposits, rent increases, harassment, privacy problems, abandoned property, and other aspects of Colorado law. They also refer to other legal avenues

It cant hurt to have a second opinion and it's free. Besides, they will be more current with any recent changes in colorado tenant laws. Of course your attorney could and will be able to easily access that information, if it isn't his usual arena, then that could take a little research on his part. This could save some time.

If you are paying your own way, then in no uncertain terms tell them to piss off and quit harassing you. Then just ignore them.

It makes no sense to me to harass long term, good paying tenants ... unless .... they want rid of you in order to lease the space for more $ to someone else.

I have a stellar tenant in one of my houses. Never late on rent, not a single complaint. I could be getting $200 more per month, but am happy to keep her at the current rent because she is so great.

Quiet enjoyment - is legalese for use of property for which it was intended (to live in, in your case) without harassment. By suddenly demanding extra financials after you were granted the lease, is harassment.

.... OP has absolutely no Federal or State Constitutional rights or remedies for any injuries done. The good news is that some thing bad does happen, she can get a postcard in the mail 10 years from now with her $15 check from a class action settlement. That depends on the terms of the lease.

Divorce settlements are public record, if they want it for legal reasons then their lawyer could easily file and receive the records for a small fee.

Something is not right.

If they needed the records the best way would be never to even tell you and just pull it, in-fact the Lawyer would insist on doing it that way because it is then a billable action that makes the lawyer money!

well, i didn't get uptight or get angry in front of her but i did tell her that i would not provide her a copy of my divorce decree. i told her she didn't need to see it or know the contents of it, and she had no right to ask me about how often my ex visits my kids. then she went into a long diatribe about how CHFA demand this and non-compliance means lease violation, yadda yadda yadda.

i compromised and offered her a copy of the court paper that shows a CS modification. even that seemed a bit invasive since i already proved i received court ordered child support at my lease signing.

The only way i could see them needing this info is for income IF its 'low income' housing with an income cap (or like others said = to meet minimum income requirements)

it's not government housing.
it is tax break real estate for allowing section 8 and low income people to live there.

not all tenants are section 8.

i verified that it is tax credit community the last time they knocked on my door asking for unreasonable shit.

They can ask for what ever they want.....

I have a young couple (newlyweds with a newborn) that just moved into an apartment. The land lord put a video camera outside there door to monitor them. The landlord decided they have too much traffic and tried to evict them after the first month.
They got a lawyer that is helping with the harassment.

Even though Im sticking up for the young couple. Being a land lord is hard...People stiff you, sue you and try to do anything else to get out of paying rent. Then no matter how bad theyre trashing your place....you have to wait 90 days to get the little fuckers out.

Years ago a friend ran a movie theater. The owner would only hire ex-convicts for him to train. One lady came out and told me shes rented houses over 30 years and NEVER left a place paying a months rent. She said when ever it came time to leave she would open a law suit...she would normally get all of her past rent back and then some....

No. And FWIW,words on paper are just words on paper. It doesn't mean that agreements don't change or that god forbid and something happens and you don't get your child support.

That is your personal information. It probably has your social numbers on it somewhere and maybe even your kids numbers.

My advice is to say, okay, yeah and then forget about it. You don't want to piss people like this off. Bide your time and then move the hell away.

Hopefully they won't find a way to get more involved in your life like false CPS allegations and stuff like that... so just make nice, but don't give them anything. Avoid contact with these people.

i asked her that but used different wording. i asked her point blank why, when i already provided verification of my income, household status, student info, etc, does she need to RE-verify? i asked, "why do you need to continually verify my income and household status when i just did all that 6 months ago when i moved into this unit?" Isn't signing the lease agreement the standard for "i am verified and i qualify"?

then i asked what type of document can i bring to her that she doesn't already have? that's when she wanted to see my divorce decree. i told her no, that was too invasive.

then she got stumped and got on the phone with CHFA lady from the state.

If you apartment complex has applied for funding from your state or county certain paperwork to prove income is required per tenant.


Also, if you feel that this is not the case you should report this owner to your Department of Real Estate.
