Looks like he's laying the groundwork for the Executive Branch to ignore nationwide injunctions outside the ruling court's district.

That idiot judge from Hawaii will no longer be allowed to overstep his authority, halt Trump's executive orders, and rely on the media for protection.

---------------------

mrsentinel
He is laying groundwork in multiple hostile courts. Cite the same case law and let judges do illegal rulings. Elevate case to supreme court and cite the multiple cases.
Supreme court then slaps all lower courts to take away their nationwide injunction authority.

---------------------

SDsc0rch
would a lawyer/legally-minded individual please ELI5 for non-legal-minded?

nishinoran
Essentially it looks like they're beginning the steps necessary to fix cases like the Travel Ban, where an executive order, clearly within the President's powers, was held up nation-wide by a decision from a single judge in Hawaii.

---------------------

libertyprime48
I'm not a lawyer but it looks like the executive branch and justice department may start to ignore nationwide injunctions, since federal activist judges have abused them numerous times. Using nationwide injunctions to block Trump's travel ban was probably the most egregious example of federal judges going beyond the limitations of their jurisdiction.

In releasing the litigation guidelines, Attorney General Sessions provided the following statement:

“Increasingly, we are seeing individual federal district judges go beyond the parties before the court to give injunctions or orders that block the entire federal government from enforcing a law or policy throughout the country. This kind of judicial activism did not happen a single time in our first 175 years as a nation, but it has become common in recent years. It has happened to the Trump administration 25 times in less than two years. This trend must stop. We have a government to run. The Constitution does not grant to a single district judge the power to veto executive branch actions with respect to parties not before the court. Nor does it provide the judiciary with authority to conduct oversight of or review policy of the executive branch. These abuses of judicial power are contrary to law, and with these new guidelines, this Department is going to continue to fight them.”

In a recent speech to the Eight Circuit Judicial Conference, the Attorney General stressed that the use of nationwide injunctions threatens the rule of law. The Attorney General also emphasized how nationwide injunctions are a danger to our constitutional order in a March op-ed (link is external). The litigation guidelines published today will strengthen the Department’s efforts to help restore order, boundaries, and common sense to the U.S. judicial system.

Prosecute those democrat activist judges who violate the law.
Kamala Harris is not a Natural Born Citizen. She's illegally running.

Used by the Founders...
Book I of The Law of Nations, Chapter XIX, § 212 (Joseph Chitty numbering) – “Citizens and natives”
reads: 'The citizens are the members of the civil society; bound to this society by certain duties, and subject to
its authority, they equally participate in its advantages. The natives, or natural-born citizens, are those born in
the country, of parents who are citizens. As the society cannot exist and perpetuate itself otherwise than by
the children of the citizens
, those children naturally follow the condition of their fathers, and succeed to all
their rights.' 1758 Emerich de Vattel

Oh' What the Hell, do I look like I want to die in some nursing home one day...
America must have 4 new Constitutional Amendments...
1. Drug Tests and Mental Evaluations on all politicians and judges randomly five times per year.
2. Term Limits for Federal politicians and judges.
3. Mental and health standards for Supreme Court Justices and retirement age set.
4. A 'Star Chamber' of elected Natural Born Citizens (no attorney's) to ivestigate, try, and prosecute the politicians and government employee's as they see fit.

Mandatory death penalty by public hanging is the merciful sentence for pedos and their associates.

He is documenting evidence and precedence while being very meticulous with the minutiae. The courts were already doing this under other administrations, but the Executive Branch under Trump would look vindictive/political (or at least that is how MSM and Dems would portray it) to go after prior infractions of judicial overreach. Instead, they allowed it to occur under Trump’s Admin, so these courts can be taken to the Supreme Court. They are in serious shit. This whole slow-roll-set-up is like the best and longest foreplay of my life...

Edited to add: watch Ghomert here at 05:20:00. He lays down all of the crimes on the public record (listen especially to him allude to the Rosenbergs). All of these guys are foreshadowing by putting all of the crimes into the public record.

This memo contains instructions to the trial lawyers who litigate for the US DOJ. It's like your boss walking up and telling you to do something, and giving you the authority to do it. This memo could be big. What will probably happen is that the DOJ litigators will call BS on obstructionist judges rulings. This memo tells those lawyers how to frame the issues in their cases, so that if the case gets before the US Supreme Court, there is a valid legal basis for slapping the obstructionist judges down.

I am still reading thru the memorandum, but it seems to be good, carefully crafted legal work.

Trump always follows the law, no matter how stupid the law is. Sometimes he finds a way to get things done through "loopholes" or other means, and that's perfectly legal, and it's especially fun when the left screams bloody murder about it. But here, he needs to defeat these judges direcly by removing their authority to do this.

At least I don't see any intention to ignore judges here, but to overrule them within their legal system.
