Easiest think I've ever done. Serious. For years I've managed to convince myself that it will be impossible, and beside, 'I love smoking'. Then the tax came. We simply couldn't afford anymore. Great substitute for determination. Never thought I will be praising tax, :). However, I remember thinking often, that one day I'll just wake up and be a non-smoker. The only way I would accept it, ...i decided to call my shots. Well, it happen. Two yrs worth of taxes. The Jenkins act we proved that it is for resellers only- it clearly says -on CHAPTER 10A SECTION 375 (3) THE TERM DISTRIBUTOR LICENCED BY OR LOCATED IN SUCH A STATE MEANS - A - IN THE CASE OF ANY STATE WHICH BY STATE STATUTE OR REGULATION AUTHORIZES THE DISTRIBUTION OF CIGARETTES AT WHOLESALE OR RETAIL; BUT SUCH TERM IN NO CASE INCLUDES A PERSON WHO AQUIRES CIGARETTES FOR PURPOSE OTHER THAN RESALE. THEY THEN MADE UP LAWS AS THEY WENT- WHEN WE FOUGHT. WE LOST IN THE END THOUGH. |

It is not the IRS (THAT IS ALSO WHAT THE STATE OF UTAH TRIED TO TELL ME) I checked that out with the IRS - not them- not under their code. They make up all kinds of things - The laws now force the Indian tribes to give names addresses etc. to the State that is inquiring of who has purchased from them. I used a charge card so they traced me. It is the State you live in! |
